【摘要】：根據(jù)國(guó)際較為公認(rèn)的觀點(diǎn),環(huán)境公平是指在環(huán)境法律、法規(guī)和政策的發(fā)展、實(shí)施和執(zhí)行方面,所有人——無(wú)論種族、膚色、國(guó)籍或收入——均可獲得公平對(duì)待以及有效的參與。環(huán)境知情權(quán)則是實(shí)現(xiàn)環(huán)境公平保障的組成部分。筆者發(fā)現(xiàn),其它國(guó)家或地區(qū)要么在憲法性文件中明確規(guī)定了環(huán)境知情權(quán)屬于環(huán)境權(quán)利或環(huán)境責(zé)任,要么沒(méi)有相關(guān)的憲法條文,但強(qiáng)調(diào)了環(huán)境知情權(quán)的強(qiáng)制執(zhí)行效力。在我國(guó),為了建設(shè)"美麗中國(guó)"和實(shí)現(xiàn)"中國(guó)夢(mèng)",當(dāng)前亟需一部明文規(guī)定環(huán)境權(quán)或健康環(huán)境權(quán)的"環(huán)保"憲法。執(zhí)法機(jī)關(guān)和司法機(jī)關(guān)也應(yīng)積極履行其環(huán)境職責(zé),這樣才能有效促進(jìn)守法行為和懲罰違法行為。
[Abstract]:According to the more internationally accepted view, environmental equity refers to all persons, regardless of race, colour, in the development, implementation and enforcement of environmental laws, regulations and policies. Nationality or income-can get fair treatment and effective participation. The right to know about the environment is part of the protection of environmental equity. Other countries or regions either explicitly stipulate that the right to know the environment belongs to the environmental rights or responsibilities in the constitutional documents, or there are no relevant constitutional provisions. But it emphasizes the enforcement effect of the right to know about the environment. In our country, in order to build "beautiful China" and realize "Chinese Dream". At present, there is an urgent need for an "environmental protection" constitution that explicitly stipulates the right to environment or the right to a healthy environment. Law enforcement agencies and judicial organs should also actively perform their environmental duties in order to effectively promote law-abiding acts and punish illegal acts.
