【摘要】：環(huán)評(píng)審批是環(huán)保部門(mén)依職權(quán)作出的具有高度科技專(zhuān)業(yè)性的行政行為,法院如何審查高度科技專(zhuān)業(yè)性行政行為值得關(guān)注。通過(guò)分析我國(guó)的62起環(huán)評(píng)行政訴訟案件可以發(fā)現(xiàn):在實(shí)體審查方面,法院往往以欠缺相關(guān)的知識(shí)與技術(shù)為由,采取尊重行政機(jī)關(guān)的專(zhuān)業(yè)性判斷的態(tài)度;在程序?qū)彶榉矫?法院僅審查程序是否形式合法,而不過(guò)問(wèn)程序是否實(shí)質(zhì)合法或是否正當(dāng)。司法審查的退讓使得針對(duì)環(huán)評(píng)審批的司法監(jiān)督名存實(shí)亡,環(huán)評(píng)審批權(quán)在"科技專(zhuān)業(yè)性"的遮掩下不斷被濫用。為制約行政權(quán),確保環(huán)評(píng)預(yù)防環(huán)境污染與生態(tài)破壞功能的發(fā)揮,法院應(yīng)將審查的重點(diǎn)放在程序上,在程序?qū)彶橹凶裱?dāng)行政程序標(biāo)準(zhǔn),同時(shí),亦應(yīng)在實(shí)體審查中確立合理性審查標(biāo)準(zhǔn)。
[Abstract]:EIA examination and approval is a highly scientific and professional administrative act made by the environmental protection department in accordance with its authority. By analyzing 62 administrative litigation cases of environmental impact assessment in China, it can be found that: in the aspect of entity review. Courts often take the attitude of respecting the professional judgment of administrative organs on the basis of lack of relevant knowledge and technology; In the aspect of procedural review, the court only reviews whether the procedure is legal, but not whether the procedure is actually legal or legitimate. The concession of judicial review makes the judicial supervision of EIA examination and approval exist in name. In order to restrict the administrative power and ensure the function of environmental impact assessment to prevent environmental pollution and ecological destruction, the court should focus on the procedure. The standard of due administrative procedure should be followed in the examination of procedure, and the standard of reasonableness should also be established in the examination of entity.
