【摘要】：生態(tài)權(quán)益是在黨的十八大后首次提出的,它與經(jīng)濟(jì)權(quán)益、政治權(quán)益、文化權(quán)益、社會(huì)權(quán)益等權(quán)益一樣都是人權(quán)的重要組成部分,也是實(shí)現(xiàn)人的全面發(fā)展必不可少的重要條件。人們的生存和發(fā)展離不開自然環(huán)境,農(nóng)民是對(duì)社會(huì)發(fā)展影響更為深刻的人,其全面發(fā)展的權(quán)利自然不能被忽視,但是因農(nóng)村生態(tài)環(huán)境的破壞,農(nóng)村這個(gè)農(nóng)民最終的棲生之所正在遭受各方的侵害,農(nóng)民的生存權(quán)和發(fā)展權(quán)已經(jīng)面臨了巨大的挑戰(zhàn)。而且農(nóng)民是各項(xiàng)權(quán)益保護(hù)上的弱者,加強(qiáng)對(duì)農(nóng)民生態(tài)權(quán)益的研究,具有重要的現(xiàn)實(shí)的意義。本文首先通過了解生態(tài)權(quán)益的概念,明白其科學(xué)內(nèi)涵,并將其與特殊群體農(nóng)民相結(jié)合,得出何謂農(nóng)民生態(tài)權(quán)益以及農(nóng)民生態(tài)權(quán)益所包含的具體內(nèi)容。明晰“什么是農(nóng)民的生態(tài)權(quán)益”。通過對(duì)農(nóng)民生存環(huán)境存在的問題、農(nóng)民生態(tài)權(quán)益缺失現(xiàn)狀、農(nóng)民生態(tài)權(quán)益缺失的危害三個(gè)層面進(jìn)行研究分析,得出管理體制原因?qū)е碌某青l(xiāng)二元社會(huì)結(jié)構(gòu),政府監(jiān)管存在主觀矛盾;法律原因?qū)е碌霓r(nóng)民生態(tài)權(quán)益保護(hù)立法不完善、執(zhí)法力度不夠、司法保障存在缺陷;經(jīng)濟(jì)原因?qū)е碌泥l(xiāng)鎮(zhèn)企業(yè)污染嚴(yán)重、城鄉(xiāng)之間污染轉(zhuǎn)嫁、農(nóng)民發(fā)展觀念落后;社會(huì)原因?qū)е碌霓r(nóng)民法律意識(shí)淡薄、企業(yè)社會(huì)責(zé)任感缺失是農(nóng)民生態(tài)權(quán)益缺失的制約因素,明白“為什么要保護(hù)農(nóng)民生態(tài)權(quán)益”。針對(duì)上述制約因素,提出農(nóng)民生態(tài)權(quán)益保護(hù)的制度層面、法律層面、經(jīng)濟(jì)層面、社會(huì)層面的實(shí)現(xiàn)對(duì)策,明確“農(nóng)民生態(tài)權(quán)益保護(hù)要怎么做”。
[Abstract]:Ecological rights is put forward for the first time in eighteen after the party's, and its economic interests, political rights, social rights and cultural rights, rights are an important part of human rights, but also an essential condition for the all-round development of people. The existence and development of people cannot do without the natural environment, farmers is the impact on society the development of a more profound, the all-round development of the rights of nature can not be ignored, but due to the destruction of the ecological environment in rural areas, the rural farmers eventually habitat of the parties is suffering from infringement, the right to survival and development of farmers has been facing a huge challenge. And farmers protect the rights and interests of the weak. To strengthen research on Farmers' ecological interests, has important practical significance. Firstly, through the understanding of the concept of ecological interests, understand its scientific connotation, and the combination of special groups of farmers, too What is the specific content of the rights and interests of farmers and farmers ecological ecological rights contained in the clear. "What is the ecological interests of farmers. Through the living environment of farmers, the status of ecological rights of farmers, farmers' ecological rights and interests harm three levels, two urban and rural dual social structure result in management system of reason government regulation, subjective contradiction; legal causes of farmers' ecological protection legislation is not perfect, lack of enforcement of judicial protection defects; economic causes serious pollution of township enterprises, pollution transfer between urban and rural areas, farmers concept behind the development of the law consciousness of the peasants; social causes of the weak, lack of corporate social responsibility is restricted the ecological factors of farmers' rights and interests, to understand" why should we protect the ecological interests of farmers ". In view of the above factors, the farmers The system level of ecological rights and interests protection, the legal level, the economic level, and the social level to realize the countermeasures, clear "how to do the protection of farmers' ecological rights and interests".
