【摘要】：修訂后的環(huán)保法第63條規(guī)定有"行政拘留",且要求將案件移送公安機(jī)關(guān),最近全國(guó)人大頒布的網(wǎng)絡(luò)安全法也規(guī)定了"行政拘留",引起學(xué)界高度關(guān)注。一是該"行政拘留"并非治安性質(zhì),如環(huán)保法中的拘留,易引起拘留性質(zhì)和分類及執(zhí)法主體的爭(zhēng)論。二是有可能引發(fā)行政刑法的轉(zhuǎn)向,即在我國(guó)刑法之外建構(gòu)"準(zhǔn)刑事性質(zhì)"的"行政刑法",內(nèi)容包括行政拘留、收容教養(yǎng)、收容教育、強(qiáng)制戒毒等人身自由罰的司法化,以及建構(gòu)行政刑法程序問題等。
[Abstract]:Article 63 of the revised environmental protection law provides for " administrative detention " and requires that the case be transferred to the public security organ , and that the network security law promulgated by the National People ' s Congress has also provided for " administrative detention " , which has raised the attention of the academic circle . One is that the " administrative detention " is not a public security character , such as detention in environmental protection law , easy to cause detention property and classification and the subject of law enforcement .
