【摘要】：放良書是敦煌出土的契約文書中較為重要的一種,據(jù)統(tǒng)計(jì),總共有九件,這些放良書大多涉及佛教觀念的內(nèi)容,佛教倫理成為保證契約有效性與合法性的重要基礎(chǔ)。究其原因,唐五代以來(lái),佛教已經(jīng)大面積地滲入社會(huì)基層,并內(nèi)化為大眾的倫理規(guī)范,直接或間接地影響著地方的司法實(shí)踐。官府對(duì)于相關(guān)民事法令的推行,常常依托于佛教觀念本身勸善懲惡的功能來(lái)實(shí)現(xiàn)。
[Abstract]:Fangliangshu is one of the most important documents of the contract unearthed in Dunhuang. According to statistics, there are nine books, most of which are related to the content of Buddhist ideas. Buddhist ethics has become an important basis to guarantee the validity and legitimacy of the contract. The reason is that since the Tang and five dynasties, Buddhism has penetrated into the social grassroots in a large area, and internalized into the ethical norms of the masses, directly or indirectly affecting the local judicial practice. The implementation of relevant civil laws by the government often depends on the function of Buddhism itself in persuading good and punishing evil.
