何謂“法的信仰”——一種馬克思主義政治哲學(xué)的分析

【摘要】：在現(xiàn)代性語境中,一種信仰要有效確立必須建基于當(dāng)下的現(xiàn)實生活世界,體現(xiàn)對普遍性公民權(quán)利的認(rèn)肯與確證。這種孕于以市場經(jīng)濟(jì)為基礎(chǔ)的生活世界中、以權(quán)利的關(guān)注與維護(hù)為核心、與共產(chǎn)主義意識形態(tài)相涵容的信仰形態(tài),可稱之為"法的信仰"。法的信仰指在以市場經(jīng)濟(jì)為基礎(chǔ)的社會形態(tài)中,公民個體或社會群體在現(xiàn)實的生產(chǎn)與生活實踐中,基于自身的感受、體驗與認(rèn)知,對反映經(jīng)濟(jì)交往以及社會存在、發(fā)展必然規(guī)律的應(yīng)然價值原則與權(quán)利要求的極度認(rèn)同、真誠推崇、熱忱捍衛(wèi)與不懈追求。這種應(yīng)然的價值原則與權(quán)利要求源生自經(jīng)濟(jì)領(lǐng)域,而衍生至整個政治、社會與文化領(lǐng)域,一般會通過具有時代內(nèi)涵的學(xué)說體系得到總結(jié)與升華。在現(xiàn)代社會,法的信仰展示為一種包括發(fā)生機(jī)制、實現(xiàn)機(jī)制、文化機(jī)制與功能機(jī)制在內(nèi)的整體性的機(jī)制建構(gòu)。
[Abstract]:In the context of modernity, if a belief is to be effectively established, it must be based on the present real life world and embody the recognition and confirmation of universal civil rights. This kind of belief form, which is pregnant in the life world based on market economy, takes the concern and maintenance of rights as the core, and contains with communist ideology, can be called "belief of law". In the social form based on market economy, the belief of law refers to the extreme recognition of the value principle and right requirement that reflects the economic communication and social existence and the necessary law of development in the practical production and life practice of citizens or social groups, based on their own feelings, experience and cognition, sincere respect, enthusiastic defense and unremitting pursuit. This kind of value principle and right requirement originates from the economic field, but originates from the whole political, social and cultural fields, and generally gets summarized and sublimated through the theoretical system with the connotation of the times. In modern society, the belief of law is displayed as a holistic mechanism construction, including occurrence mechanism, realization mechanism, cultural mechanism and functional mechanism.
