【摘要】：本文立足于馬克思主義的立場(chǎng)、觀點(diǎn)和原則對(duì)當(dāng)代西方學(xué)術(shù)界的一個(gè)前沿、熱點(diǎn)的理論觀點(diǎn)進(jìn)行批判性分析。由于篇幅和筆者能力所限,本文不可能窮盡全球正義的所有問題和環(huán)節(jié),而是以凸顯重點(diǎn)議題為原則。在掌握國內(nèi)外相關(guān)研究資源的基礎(chǔ)之上,本文就以下幾個(gè)問題進(jìn)行重點(diǎn)分析與探討： 第一,厘清全球正義復(fù)興的理論基礎(chǔ),并對(duì)全球正義興起的現(xiàn)實(shí)原因進(jìn)行簡(jiǎn)要剖析。這一內(nèi)容在本文的第一章來完成。筆者首先從最基本的正義的概念、康德的世界公民理論、羅爾斯的《正義論》三方面闡述了全面正義復(fù)興的理論基礎(chǔ)。隨后指出了全球化對(duì)整個(gè)世界的沖擊及挑戰(zhàn),進(jìn)而闡述了由全球化產(chǎn)生的全球不平等問題是全球正義興起的現(xiàn)實(shí)條件。 第二,考慮到“全球正義”對(duì)于國內(nèi)學(xué)界來說還不是一個(gè)非常熟悉的主題,因此本文在第二章對(duì)全球正義研究的主要視角進(jìn)行了考察；對(duì)全球正義的基本內(nèi)容進(jìn)行分析和解釋；對(duì)全球正義實(shí)現(xiàn)的可能性進(jìn)行了簡(jiǎn)單論述。雖然完成這一部分的寫作更多采用的是描述性或述評(píng)式的方法來進(jìn)行的,但因國內(nèi)學(xué)術(shù)界對(duì)全球正義的研究多以譯介為主,深度研究不足,因而本文對(duì)全球正義所做的這種系統(tǒng)梳理是有一定意義的,能夠?yàn)閲鴥?nèi)學(xué)術(shù)界對(duì)全球正義的拓展性研究提供基礎(chǔ)。當(dāng)然,這項(xiàng)工作對(duì)于本文論題的完成也是一個(gè)必要前提。 第三,本文在第三章對(duì)全球正義的利弊進(jìn)行了簡(jiǎn)單的評(píng)價(jià)。在歸納整合的過程中挖掘了全球正義的三點(diǎn)主要貢獻(xiàn),即對(duì)人權(quán)的關(guān)注；追問“誰來承擔(dān)全球正義的責(zé)任”,促進(jìn)全球經(jīng)濟(jì)政治體制改革及提出了全球分配正義的思想。同時(shí),也指出了全球正義存在的局限性,即全球正義具有較濃厚的烏托邦色彩；全球正義忽視了多元文化的事實(shí)；全球正義忽視了地方正義的重要性。此部分辯證的剖析全球正義有利于我們更好的研究和借鑒全球正義這一人類共同文明成果,去其糟粕、吸收其理論精華。 第四,為處于社會(huì)轉(zhuǎn)型時(shí)期的中國提供值得借鑒的公平正義思想。此部分是本文研究的價(jià)值和意義所在。首先,筆者闡述了全球正義給予我們的啟示,在此基礎(chǔ)上,簡(jiǎn)單論述了我國對(duì)全球范圍內(nèi)正義問題的應(yīng)對(duì)措施,如積極參與全球規(guī)則的制定、履行義務(wù),承擔(dān)國家責(zé)任及加強(qiáng)國際合作。本部分的著力點(diǎn)在于,我國對(duì)于國內(nèi)正義問題的應(yīng)對(duì)。筆者從堅(jiān)持法律主治和制度優(yōu)先原則；構(gòu)建公平的全民共享的社會(huì)保障體系；完善我國公民的基本政治權(quán)利；規(guī)范權(quán)力行為,劃清權(quán)力與市場(chǎng)的邊界,嚴(yán)格限制權(quán)力市場(chǎng)化四方面展開了研究。
[Abstract]:Based on the position, viewpoint and principle of Marxism, this paper makes a critical analysis of a frontier and hot theoretical viewpoint in contemporary western academic circles. Due to the limitations of space and the author's ability, this paper can not exhaust all the problems and links of global justice, but to highlight the key issues as the principle. On the basis of mastering the relevant research resources at home and abroad, this paper focuses on the following issues: first, clarify the theoretical basis of the revival of global justice, and briefly analyze the practical reasons for the rise of global justice. This content is completed in the first chapter of this paper. First of all, the author expounds the theoretical basis of the revival of comprehensive justice from three aspects: the most basic concept of justice, Kant's theory of world citizens and Rawls' Theory of Justice. Then it points out the impact and challenge of globalization on the whole world, and then expounds that the global inequality caused by globalization is the realistic condition for the rise of global justice. Secondly, considering that "global justice" is not a very familiar theme for domestic academic circles, this paper examines the main perspective of global justice research in the second chapter; analyzes and explains the basic contents of global justice; and briefly discusses the possibility of realizing global justice. Although more descriptive or critical methods are used to complete this part of the writing, because most of the domestic academic research on global justice is mainly translation and introduction, the in-depth research is insufficient, so the systematic combing of global justice in this paper is of certain significance, which can provide a basis for the extended study of global justice in domestic academic circles. Of course, this work is also a necessary prerequisite for the completion of the topic of this paper. Third, in the third chapter, this paper makes a simple evaluation of the advantages and disadvantages of global justice. In the process of induction and integration, this paper excavates three main contributions of global justice, that is, paying attention to human rights, asking "who will bear the responsibility of global justice", promoting the reform of global economic and political system and putting forward the idea of global distribution justice. At the same time, it also points out the limitations of global justice, that is, global justice has a strong utopian color; global justice ignores the fact of multiculturalism; global justice ignores the importance of local justice. This part of dialectical analysis of global justice is conducive to our better study and reference of global justice, which is the achievement of human common civilization, to remove its dross and absorb its theoretical essence. Fourth, it provides a fair and just thought for China in the period of social transformation. This part is the value and significance of this study. First of all, the author expounds the enlightenment of global justice to us, and on this basis, briefly discusses the countermeasures of our country to the global justice problem, such as actively participating in the formulation of global rules, fulfilling obligations, assuming state responsibility and strengthening international cooperation. The focus of this part is on the response of our country to the problem of domestic justice. The author studies from four aspects: adhering to the principle of legal rule and system priority, constructing a fair social security system shared by the whole people, perfecting the basic political rights of our citizens, standardizing the behavior of power, distinguishing the boundary between power and market, and strictly restricting the marketization of power.
