張友漁早期民主思想研究

【摘要】： 張友漁是我國著名的法學家、政治學家、新聞學家,是國家重要的法律方面的專家,曾是全國人大法律委員會副主任,為國家的建設做出了突出的貢獻。同時他的學術研究涉及諸多領域,而且都造詣很深,尤其是他在早期對民主思想的研究,很有見地。 任何思想的產(chǎn)生都有特定的時代背景。張友漁早期所處的民國時期,國家內(nèi)憂外患,社會動蕩,人心思變。封建的思想面臨考驗,西方的民主思想被廣泛的傳播到中國,社會上掀起研究民主思想的熱潮。張友漁的民主思想也正是在這個時期產(chǎn)生、發(fā)展、成熟。憲政、法治、人權三個方面是他民主思想的主要內(nèi)容,憲政思想主要是對國民大會、憲法、地方自治三項憲政元素的進行內(nèi)容設計。法治思想?yún)^(qū)別于中國傳統(tǒng)的“法治”,他把法治與民治結合起來,抓住了現(xiàn)代法治觀念的靈魂。人權思想則著重于對人權體系的規(guī)劃和對人權保障手段的研究,其中新聞自由是人權的重要方面,張友漁對新聞自由的研究投入了大量精力,他以馬克思主義為基礎研究新聞,主張對新聞的管制應當符合民主精神。通過三個方面的研究張友漁將對民主的基本理解展現(xiàn)出來。張友漁早期的民主思想內(nèi)容豐富,體系完備,代表了民國時期民主思想研究的很高水平,具有很高的地位。張友漁早期的民主思想對中國產(chǎn)生了重大影響,他的一些重要理念引領了對民主的研究。但是張友漁早期的民主思想并不完美,受他政治立場等因素的影響,思想存在一定的局限性。
[Abstract]:Zhang Youyu is a famous jurist, a political scientist, a journalist, an expert in important legal aspects of the country, and a vice chairman of the NPC Law Committee, who has made outstanding contributions to the construction of the country. At the same time, his academic research involves many fields, and is very accomplished, especially in his early study of democratic thought, very insightful. The emergence of any thought has a specific background of the times. Zhang Youyu in the early period of the Republic of China, the country's internal and external troubles, social unrest, people's minds change. The feudal thought faces the test, the western democracy thought is widely spread to China, the society raises the research democratic thought upsurge. Zhang Youyu's democratic thought was also produced, developed and matured in this period. Constitutionalism, rule of law and human rights are the main contents of his democratic thought. The constitutional thought mainly designs the three constitutional elements of the National Assembly, Constitution and Local Autonomy. Different from the traditional "rule of law" in China, he combines the rule of law with the rule by the people and catches the soul of the modern concept of rule of law. The idea of human rights focuses on the planning of the human rights system and the study of the means of safeguarding human rights. Among them, freedom of the press is an important aspect of human rights. Zhang Youyu has devoted a great deal of energy to the study of freedom of the press, and he has studied the news on the basis of Marxism. He argued that the control of the press should be in line with the spirit of democracy. Through three aspects of research Zhang Youyu will show the basic understanding of democracy. Zhang Youyu's early democratic thought was rich in content and complete in system, which represented the high level and high status of the study of democratic thought in the period of the Republic of China. Zhang Youyu's early democratic thought had a great influence on China, and some of his important ideas led to the study of democracy. However, Zhang Youyu's early democratic thought is not perfect, because of his political position and other factors, his thought has some limitations.
