【摘要】：正義一詞最早出現(xiàn)在古希臘神話中,亞里士多德詳細(xì)論述了何謂正義,使正義理念走向系統(tǒng)化。伴隨時(shí)代的發(fā)展,對(duì)正義理論的研究曾一度沉寂,羅爾斯《正義論》的發(fā)表,從新掀起了學(xué)術(shù)界研究正義的熱潮。 當(dāng)前我國(guó)對(duì)正義理論的研究,大多以羅爾斯與馬克思正義觀的研究為立足點(diǎn),本文概述了馬克思與羅爾斯正義觀的主要內(nèi)容,進(jìn)而對(duì)二者正義觀做了對(duì)比分析。馬克思的正義觀的核心要求是自由和平等,把以人為本與實(shí)踐作為其正義原則;羅爾斯的正義觀主要包括自由平等的公民理念、作為公平合作體系的社會(huì)、秩序良好的社會(huì)理念以及差別的正義原則。通過(guò)對(duì)馬克思與羅爾斯正義觀的比較,可以發(fā)現(xiàn)二者雖有很大的差異之處,但也有一些相似點(diǎn),完全可以通過(guò)對(duì)話,實(shí)現(xiàn)二者的優(yōu)勢(shì)互補(bǔ)。 當(dāng)前我國(guó)正處于社會(huì)主義初級(jí)階段,不可避免地出現(xiàn)了一些影響社會(huì)正義的問題,并且受社會(huì)主義市場(chǎng)經(jīng)濟(jì)的影響,我國(guó)的正義問題呈現(xiàn)一定的復(fù)雜性,一方面要借助馬克思的正義觀來(lái)解決我國(guó)當(dāng)前的正義問題,另一方面羅爾斯的正義觀作為當(dāng)前世界最為嚴(yán)密的正義體系,必將對(duì)和諧社會(huì)下正義觀的構(gòu)建有一定借鑒作用。作者希望通過(guò)對(duì)馬克思與羅爾斯正義觀的比論來(lái)求索二者正義觀與當(dāng)代中國(guó)正義問題的融合點(diǎn),以更好地解決我國(guó)面臨的現(xiàn)實(shí)正義問題,促進(jìn)社會(huì)和諧。
[Abstract]:The word "justice" first appeared in ancient Greek mythology. Aristotle elaborated on what justice is and systematized the concept of justice. With the development of the times, the research on the theory of justice was once silent, and the publication of Rawls's Theory of Justice set off a new upsurge in the research of justice in academic circles. At present, most of the researches on justice theory in our country are based on the research of Rawls and Marx's view of justice. This paper summarizes the main contents of Marx's and Rawls' view of justice, and then makes a comparative analysis of their views of justice. The core requirement of Marx's view of justice is freedom and equality. Rawls' view of justice mainly includes the civil concept of freedom and equality, the society as a system of fair cooperation, the social concept of good order and the principle of justice of difference. Through the comparison of Marx and Rawls' view of justice, we can find that although there are great differences between them, there are also some similarities, which can be realized through dialogue and complement each other's advantages. At present, our country is in the primary stage of socialism, there are inevitably some problems affecting social justice, and under the influence of socialist market economy, the problem of justice in our country presents certain complexity. On the one hand, it is necessary to solve the problem of justice in our country with the help of Marx's view of justice. On the other hand, Rawls' view of justice, as the most rigorous justice system in the world at present, will certainly serve as a reference for the construction of the concept of justice in a harmonious society. The author hopes to find the fusion point between Marx and Rawls' view of justice and contemporary Chinese justice, so as to solve the problem of justice in our country and promote social harmony.
