【摘要】：盧梭的民主思想是一把開啟一個新時代的鑰匙。盧梭的社會契約論無處不散發(fā)著民主的自由氣息，他的人民主權(quán)理論更是現(xiàn)代民主制度的基石。我們要理解社會契約論就不可避免的要理解公意，因為公意是貫穿社會契約論始終的、最為重要、最不可或缺的根本。公意作為盧梭政治法學(xué)思想的精華，一直以來都是一個讓國內(nèi)外學(xué)者爭論不朽的課題，有人否定它，，認(rèn)為是殘暴虛無的東西；也有人贊美它，認(rèn)為是璀璨的明珠，尤爾根?哈貝馬斯、伯納德?鮑桑葵等學(xué)者更是在盧梭的公意理論的基礎(chǔ)上繼承并發(fā)展，形成了自己的公意學(xué)說。筆者作為一個盧梭公意理論的擁護(hù)者，也深信公意的存在。 本文從各家對公意理論的爭論出發(fā)，進(jìn)行思考、提出問題：應(yīng)當(dāng)以一個怎樣的角度來看待盧梭的公意理論？筆者先考察資料，分析了國內(nèi)外關(guān)于公意理論的研究狀況，而后從盧梭公意理論的提出開始，通過單個分析、多個比較，將公意與相關(guān)的如個別意志、眾意和團(tuán)體意志等#行對比分析等方式來挖掘公意的內(nèi)涵、歸納公意的特征，并通過對_,公意理論產(chǎn)生的歷史背景和思想淵源、公意理論對社會產(chǎn)生的積極春響、公意理論遇到的困難等方面來全方位理解公意理論。雖然對公意的形成過程等一些重要問題未能豁然開朗，但是筆者仍希望通過自己的研究能看清公意的內(nèi)涵、了解公意的特征、發(fā)現(xiàn)公意理論的社會價值，并為今后更深入的研究提供一些基礎(chǔ)的東西。
[Abstract]:Rousseau's democratic ideas are the key to a new era. Rousseau's theory of social contract exudes the free breath of democracy, and his theory of people's sovereignty is the cornerstone of modern democracy. If we want to understand the theory of social contract, we must inevitably understand the common will, because it is the most important and indispensable root of the theory of social contract. As the essence of Rousseau's thought of political law, public will has always been a subject for scholars at home and abroad to argue about immortality. Some people deny it and regard it as a cruel nihilistic thing. Others praise it as a bright pearl, Jurgen? Habermas, Bernard? Bosanquet and other scholars inherited and developed their own theory of public will on the basis of Rousseau's theory of public will. As an advocate of Rousseau's theory of public will, the author also believes in the existence of public will. Starting from the controversy of the theory of public will, this paper puts forward the question: what kind of perspective should Rousseau's theory of public will be treated? The author first investigates the data, analyzes the research situation of the theory of public will at home and abroad, and then begins with the proposition of Rousseau's theory of public will, and through a single analysis and multiple comparisons, the author compares the public will with the relevant ones, such as individual will. By means of comparative analysis of public will and group will, to dig out the connotation of public will, to sum up the characteristics of public will, and through the historical background and ideological origin of the theory of public will, the positive spring that the theory of public will produces to the society, The difficulties encountered in the theory of public will and other aspects to understand the theory of public will in all directions. Although some important problems such as the forming process of public will can not be suddenly opened up, the author still hopes that through his own research, he can see clearly the connotation of public will, understand the characteristics of public will, and discover the social value of the theory of public will. And for the future more in-depth research to provide some basic things.
