【摘要】：英國(guó)政治哲學(xué)家布萊恩·巴利以“公道”論正義問題,因而形成了公道正義觀。他所說的“公道”是一種基于正義原則的公道性并通過社會(huì)制度的公道性體現(xiàn)出來的公正性。他把公道區(qū)分為形式公道和實(shí)質(zhì)公道,認(rèn)為公道正義原則不可避免地具有形式性,但它們的確立有助于形式公道的現(xiàn)實(shí)化,即有助于形式公道轉(zhuǎn)化為實(shí)質(zhì)公道。他還指出,實(shí)質(zhì)公道的實(shí)現(xiàn)就是社會(huì)正義的實(shí)現(xiàn),程序正義是實(shí)現(xiàn)實(shí)質(zhì)公道的有效方式。巴利所說的公道是普遍有效的正義原則內(nèi)含的一種倫理精神,是引導(dǎo)社會(huì)制度達(dá)到合理設(shè)計(jì)和安排的原則依據(jù)和倫理基礎(chǔ),也是引導(dǎo)一個(gè)社會(huì)追求分配正義的價(jià)值目標(biāo)。 巴利的公道正義觀順應(yīng)了當(dāng)代西方政治哲學(xué)家注重張揚(yáng)社會(huì)制度維護(hù)分配正義的功能及其以普遍有效的正義原則確立社會(huì)制度的合理性基礎(chǔ)的思想主流,在當(dāng)今西方產(chǎn)生了廣泛影響。它對(duì)當(dāng)代人類的現(xiàn)實(shí)啟示主要在于：人類社會(huì)必須借助于社會(huì)制度的合理設(shè)計(jì)和安排來維護(hù)分配正義,但社會(huì)制度維護(hù)分配正義的前提條件是它本身必須具有內(nèi)在公正性——這種內(nèi)在公正性只能依靠公道的正義原則來確立,因此,人類社會(huì)的進(jìn)步與和諧穩(wěn)定借助于社會(huì)制度維護(hù)分配正義的關(guān)鍵是必須設(shè)計(jì)和安排公正或公道的社會(huì)制度。
[Abstract]:British political philosopher Brian Barley discussed the problem of justice by "justice", thus forming the view of justice. Justice is a kind of justice based on the principle of justice and reflected by the fairness of social system. He divided justice into formal justice and substantive justice, and believed that the principle of justice was inevitably formalistic, but their establishment was helpful to the realization of formal justice, that is to say, it was helpful to transform form justice into substantive justice. He also pointed out that the realization of substantive justice is the realization of social justice, and procedural justice is an effective way to realize substantive justice. The justice said by Barry is an ethical spirit contained in the principle of universal and effective justice. It is the principle basis and ethical basis for guiding the social system to achieve reasonable design and arrangement, as well as the value goal of guiding a society to pursue distributive justice. Baley's view of justice conforms to the mainstream of contemporary western political philosophers who pay attention to publicizing the function of social system and maintaining distributive justice and establishing the rational foundation of social system with universal and effective principle of justice. It has had a wide influence in the West today. Its realistic enlightenment to contemporary human beings mainly lies in: human society must resort to the rational design and arrangement of social system to maintain distributive justice. But the prerequisite for the social system to maintain distributive justice is that it must have its own inherent impartiality, which can only be established by the principle of justice. The key to the progress and harmony and stability of human society with the help of social system is to design and arrange a just or fair social system.
