【摘要】：國(guó)家主義話語(yǔ)(國(guó)家至上)影響著當(dāng)代中國(guó)的法治實(shí)踐,有必要對(duì)它進(jìn)行西方思想史的考察,即國(guó)家主義起源于古希臘羅馬,憑藉中世紀(jì)的宗教觀念迅速發(fā)展,成為文藝復(fù)興時(shí)期建構(gòu)民族國(guó)家的主要思潮。國(guó)家主義在古典時(shí)代以主權(quán)學(xué)說(shuō)和契約理論為依托而得以充分彰顯,在現(xiàn)代時(shí)刻更是通過(guò)與自由主義的博弈再次勃興。梳理國(guó)家主義的西方思想史源流,有利于深入理解當(dāng)下中國(guó)法治建構(gòu)中的國(guó)家主義立場(chǎng)。
[Abstract]:The discourse of nationalism (national supremacy) influences the practice of the rule of law in contemporary China. It is necessary to investigate the history of western ideology, that is, nationalism originated from ancient Greece and Rome, and developed rapidly by virtue of the religious ideas of the Middle Ages. It became the main trend of thought in the Renaissance to construct the nation-state. Nationalism was fully manifested in the classical era based on the theory of sovereignty and contract, and flourished again in modern times through the game with liberalism. Combing the history of nationalism in the West is conducive to a deeper understanding of the position of nationalism in the construction of the rule of law in China.
