【摘要】：否定性正義是要為自由市場秩序提供可以依賴的規(guī)則。理性主義和經(jīng)驗(yàn)主義為正當(dāng)?shù)纳鐣?huì)秩序提供的是肯定性規(guī)則,也就是只要遵循這些規(guī)則,正當(dāng)性秩序也就建構(gòu)起來了。否定性規(guī)則則與之相反,它沒有規(guī)定人的行為領(lǐng)域,而是通過限制非正當(dāng)性行為為自由行動(dòng)提供邊界,實(shí)質(zhì)上,它是在為非限制性尋找正義性的依據(jù)。但是,對自由唯一性的重視和對平等意義的忽視,使它仍然無法擺脫功利化的指責(zé),其理論結(jié)構(gòu)中的困境也在現(xiàn)實(shí)中不斷被呈現(xiàn),需要我們在探究中發(fā)現(xiàn)和修正。
[Abstract]:Negative justice is to provide the free market order with the rules that can be relied upon. Rationalism and empiricism provide positive rules for the proper social order, that is, as long as these rules are followed, the legitimate order is constructed. The negative rule, on the other hand, does not define the field of human behavior, but provides the boundary for free action by restricting illegitimate behavior. In essence, it is looking for the basis of justice for non-restriction. However, the emphasis on the uniqueness of freedom and the neglect of the meaning of equality make it still unable to get rid of the criticism of utilitarianism, and the dilemma in its theoretical structure is constantly presented in reality, which needs to be discovered and corrected in the course of exploration.
