【摘要】：在17和18世紀,契約主義在西方政治哲學(xué)中處于統(tǒng)治地位。然而,到了19世紀初,契約主義突然死亡,其支配地位被功利主義取而代之。自20世紀70年代以來,契約主義又開始死灰復(fù)燃。導(dǎo)致契約主義死亡以及重生的原因是什么?從理論上來說,最重要的原因是公平。首先,古典契約論之所以死亡,其原因在于所達成的契約是不公平的;其次,在滿足公平的條件下,契約主義能夠發(fā)展出更合理的形式;最后,以公平為尺度,我們可以區(qū)分出兩種契約主義,即霍布斯式的契約主義和羅爾斯式的契約主義。
[Abstract]:In the 17 th and 18 th centuries, contractualism was dominant in western political philosophy. By the beginning of the 19 th century, however, contractualism suddenly died and its dominance was replaced by utilitarianism. Since the 1970 s, contractualism has returned to life. What are the causes of indentured death and rebirth? In theory, the most important reason is fairness. First, the reason for the death of classical contract theory lies in the fact that the contract reached is unfair; secondly, under the condition of equality, contractualism can develop a more reasonable form; finally, by the criterion of fairness, We can distinguish two kinds of contractualism, namely Hobbesian contractualism and Rawls indentarianism.
