【摘要】：正義是社會的首要價值,是維系社會秩序、塑造社會風尚的倫理智慧。新自由主義者諾奇克與羅爾斯的正義觀在自由問題上無實質(zhì)分歧,二人爭論焦點在于如何看待平等,具體表現(xiàn)在正義基石—權利VS公正、政府角色—最低限度的國家VS多功能國家,以及分配正義—資格理論VS背景制度三方面。分析這些爭論對如何理解中國特色社會主義正義觀具有一定的理論與現(xiàn)實意義。結(jié)合中國傳統(tǒng)文化的群體價值取向和大同理想以及馬克思主義平等觀等思想淵源的分析,中國特色社會主義正義觀可借鑒"最大最小值"規(guī)則,從尊重公民基本權利,平等優(yōu)先于善;合理把握市場機制與國家調(diào)控之張力,發(fā)揮政府職能;正確處理效率與公平之關系,縮小貧富差距;建立健全社會扶貧體系,增進百姓福祉等路徑,構(gòu)建中國特色社會主義正義觀,在全面建成小康社會"最后一公里"的關鍵期做好扶貧工作,真正實現(xiàn)社會主義的公平正義。
[Abstract]:Justice is the primary value of society, the ethical wisdom to maintain social order and shape social fashion. The neoliberal Knochke and Rawls have no substantive differences on the issue of freedom. They argue that the focus is on how to treat equality, which is embodied in the foundation stone of justice-right vs justice. Government role-minimum state vs multifunctional state, and distributive justice-qualification theory vs background system. The analysis of these arguments is of theoretical and practical significance in understanding the concept of justice of socialism with Chinese characteristics. Based on the analysis of the group value orientation of Chinese traditional culture, the ideal of Datong and the Marxist concept of equality, the view of justice of socialism with Chinese characteristics can draw lessons from the rule of "maximum and minimum value" and respect the basic rights of citizens. Equality takes precedence over good; rationally grasping the tension between market mechanism and state regulation and control, giving play to government functions; correctly handling the relationship between efficiency and equity, narrowing the gap between the rich and the poor; establishing and improving the social poverty alleviation system; and promoting the well-being of the people. To construct the concept of socialist justice with Chinese characteristics, to do a good job in helping the poor in the crucial period of building a well-off society in an all-round way, and to truly realize the fairness and justice of socialism.
