【摘要】：土地征收政策作為一項公共政策，是指國家為了公共利益的需要，依照法定權(quán)限和程序，給予一定的補償，將農(nóng)民集體所有的土地收歸國家所有的行為。形成于計劃經(jīng)濟時期的我國的土地征收制度，對當時的經(jīng)濟發(fā)展起到了一定的積極作用，但隨著中國特色社會主義市場經(jīng)濟的逐步確立，在城市化進程飛速前進的同時，征地程序不公開透明，政府尋租現(xiàn)象屢見不鮮，征地補償金額過低且補償不到位這一系列由于倫理價值缺失導(dǎo)致的現(xiàn)實問題愈演愈烈，很多失去土地的農(nóng)民集體及其農(nóng)民個人的合法權(quán)益受到侵害，這不僅極大影響了社會正常秩序，也影響了城市化進程的推進，阻礙了整個社會經(jīng)濟的發(fā)展。如何改變現(xiàn)狀，使土地征收政策推進城市化進程加快經(jīng)濟發(fā)展的同時，充分顧及占據(jù)我國最大比例的人口——農(nóng)民的切身利益，無論對于公共政策實踐和公共政策理論研究來說都是一個亟待解決的問題。 土地征收政策作為政府的一項重要公共政策之一，是對社會土地資源進行配置的一種手段，其合理性直接影響了社會秩序的穩(wěn)定和利益相關(guān)者的切身利益的獲得。一個國家的經(jīng)濟發(fā)展到一定的階段，其公共政策是否公平公正是反映其政治民主程度的重要標尺。 本文從公共政策倫理價值的研究視角，，論證公共政策的倫理內(nèi)涵，研究土地征收政策的正當性、合法性。旨在說明土地征收政策應(yīng)以“公共性”作為邏輯起點，最大限度地實現(xiàn)公共利益作為根本目標。從公共政策倫理價值的視角對我國土地征收政策進行研究，不僅從微觀角度有利于提高征地的利用效率，保證社會公共利益的實現(xiàn)，而且，從宏觀的角度有利于和諧社會的構(gòu)建、我國經(jīng)濟的可持續(xù)發(fā)展。
[Abstract]:Land expropriation policy, as a public policy, refers to the behavior of the state, in order to meet the needs of the public interest, according to the legal authority and procedure, to give certain compensation to the peasants' collective ownership of the land. The land expropriation system, which was formed in the planned economy period, played a positive role in the economic development at that time. However, with the gradual establishment of the socialist market economy with Chinese characteristics, the process of urbanization was advancing rapidly. The procedure of land expropriation is not open and transparent, the phenomenon of rent-seeking by the government is common, the amount of compensation for land expropriation is too low and the compensation is not in place a series of practical problems caused by the lack of ethical value are becoming more and more serious. Many peasant collectives who have lost their land and their individual rights and interests have been infringed, which has not only greatly affected the normal social order, but also affected the progress of urbanization and hindered the development of the whole society and economy. How to change the present situation so that the land expropriation policy can accelerate the process of urbanization and accelerate the economic development, while taking full account of the vital interests of the largest proportion of the population-farmers in our country, Both the practice of public policy and the theoretical study of public policy are an urgent problem to be solved. As one of the important public policies of the government, the land expropriation policy is a means to allocate the social land resources, and its rationality directly affects the stability of the social order and the acquisition of the vital interests of the stakeholders. When a country's economy develops to a certain stage, whether its public policy is fair or not is an important criterion to reflect the degree of political democracy. From the perspective of the ethical value of public policy, this paper demonstrates the ethical connotation of public policy and studies the legitimacy and legitimacy of land expropriation policy. The purpose of this paper is to explain that the policy of land expropriation should take "publicity" as the logical starting point and realize the public interest as the fundamental goal to the maximum extent. The study of land expropriation policy in China from the perspective of ethical value of public policy can not only improve the utilization efficiency of land expropriation, but also guarantee the realization of social public interest. From the macro point of view is conducive to the construction of a harmonious society, the sustainable development of our economy.
