【摘要】： 目前,我國的改革開放已經(jīng)進入關鍵時期,政治體制的改革、利益關系的調(diào)整,使人們所面臨的政治權利的喪失和侵害等社會風險日益增多；權力的腐敗與泛濫,政治體制改革進展緩慢以及政治制度的各種不和諧性因素的激化,已成為不可忽視的社會政治問題。在此種背景下,急需相關的政治機制來發(fā)揮有效的調(diào)節(jié)和規(guī)范作用。契約政治正是這樣一項社會政治制度,它通過契約來規(guī)范和約束國家和公民的政治行為,用契約理念來規(guī)范和：提高公民的政治行為和政治意識,用政治領域的契約之治來規(guī)范國家和政府的公共行為,來維持社會政治的和諧與穩(wěn)定,使締約各方都能自覺行使權利和履行義務,最終實現(xiàn)政治生活契約化和契約政治制度化,為構建社會主義和諧社會提供有效的政治保證。然而,由于我國的契約政治尚處于萌芽狀態(tài),契約精神發(fā)育不充分,相應的配套制度仍不健全,基本功能定位模糊,導致契約政治還不能有效承擔起上述社會重任。 針對契約政治的建設,國內(nèi)學者大都從培育契約精神這一單視角出發(fā),圍繞契約精神的發(fā)育和培養(yǎng),提出建設契約政治的種種建議。然而,契約政治作為一項具有哲學、政治學和法學等復合特性的社會政治制度,真正需要的是從哲學、政治學和法學等多重視角出發(fā)為其自身建設與運行提供可行性的理論依據(jù)。本文便是從哲學、政治學以及法學等多重視角出發(fā),采用學科交叉分析的方法,運用哲學、政治學、法學并輔以社會學的相關知識,以探討契約政治建設及其運行的路徑選擇為主,就如何建設和完善契約政治這一問題問題進行探討。 筆者從契約政治的歷史沿革入手,分析東西方契約政治的發(fā)展脈絡,進而揭示和分析契約政治繁榮與衰落的深層次原因及其社會政治影響。通過分析契約憲政的社會功效探索契約政治發(fā)展的寶貴經(jīng)驗,尤其是近代西方契約政治所造就的民主、法制精神和自由、平等觀念。圍繞社會主義和諧社會的契約政治建設的現(xiàn)狀、原則、條件、機制、內(nèi)容和完善全方位、多層次地深入研究契約政治與和諧社會的關系,構建一整套適合中國特色社會主義的嶄新的契約政治發(fā)展理念。 用契約來論證國家的產(chǎn)生雖然已成歷史,甚至在某些特定時期(如西歐中世紀)契約思想還被披上了神學外衣,成為宗教統(tǒng)治世俗社會的理論根源,但這種特定意義上的消失和特定環(huán)境下的扭曲并不能否定契約理論的歷史功績。我們應當對社會主義和諧社會的契約政治建設充滿信心和希望,從理念、制度和意識形態(tài)等各個層面不斷地推動契約政治建設與和諧社會構建。
[Abstract]:At present, China's reform and opening up has entered a critical period, the political system reform, the adjustment of interest relations, people are faced with the loss of political rights and violations of social risks are increasing, power corruption and flooding, The slow progress of political system reform and the intensification of various disharmonious factors in political system have become social and political problems that can not be ignored. In this context, relevant political mechanisms are urgently needed to play an effective regulatory and normative role. Contractual politics is just such a social and political system, which regulates and restricts the political behavior of the state and citizens through the contract, standardizes and enhances citizens' political behavior and consciousness with the concept of contract. The governance of contract in the political field is used to regulate the public behavior of the state and the government, to maintain the social and political harmony and stability, to enable all parties to the contracting parties to exercise their rights and fulfill their obligations consciously, and finally to realize the political life contract and the institutionalization of contract politics. To build a socialist harmonious society to provide an effective political guarantee. However, because the contract politics in our country is still in its infancy, the contract spirit is not fully developed, the corresponding supporting system is still not perfect and the basic function is vague, the contract politics has not been able to undertake the social responsibility mentioned above effectively. In view of the construction of contract politics, most of the domestic scholars put forward various suggestions on the construction of contract politics from the single angle of view of cultivating the spirit of contract and focusing on the development and cultivation of the spirit of contract. However, as a social and political system with the complex characteristics of philosophy, politics and law, what is really needed in contract politics is philosophy. Political science and law provide the theoretical basis for its own construction and operation. This article is from the philosophy, political science and law and other multi-perspectives, using the method of interdisciplinary analysis, using philosophy, political science, law, and supplemented by the relevant knowledge of sociology. This paper mainly discusses the construction of contract politics and the choice of its operation path, and discusses how to build and perfect contract politics. Starting with the historical evolution of contract politics, the author analyzes the development of contract politics in East and West, and then reveals and analyzes the deep reasons for the prosperity and decline of contract politics and its social and political influence. By analyzing the social effect of contract constitutionalism, this paper explores the valuable experience of the development of contract politics, especially the democracy, the spirit of legal system and the concept of freedom and equality created by modern western contract politics. The present situation, principles, conditions, mechanisms, contents and perfection of the construction of contract politics in a harmonious socialist society are studied in depth and at various levels. Construct a whole set of new contract political development idea suitable for socialism with Chinese characteristics. Although it has become a history to demonstrate the emergence of a country by contract, even in certain periods (such as the Middle Ages of Western Europe) the idea of contract was put on a theological cloak, which became the theoretical root of religious domination of secular society. However, the disappearance of the contract theory and the distortion in the specific environment do not negate the historical achievements of the contract theory. We should be full of confidence and hope in the construction of contract politics in socialist harmonious society, and constantly promote the construction of contract politics and harmonious society from various aspects, such as idea, system and ideology.
