【摘要】：《社會契約論》歷來被視為政治學名著,盧梭在其中提出了"人生而自由,卻無時不身帶枷鎖"的著名論斷。借助社會契約論,他試圖從政治上把每個人"天然的自由"轉(zhuǎn)換成"約定的自由"。"約定的自由"之所以比"天然的自由"更可取,其優(yōu)勢在于公意,以及在公意基礎(chǔ)上形成的政治體帶來的好處。盧梭從理論上保證了公意的正當性,這種正當性就其本質(zhì)而言是不會出錯的。但是,隨著公意在實踐中的一步步固化,它的正當性幾乎處處面臨著折損的危險。為了防止公意損失其正當性,盧梭步步設(shè)防,殫精竭慮。最終他認識到,僅靠政治設(shè)計不足以保正公意的正當性,還得借助民情,于是他設(shè)計了一套與之相應(yīng)的"公民宗教"。但這種公民宗教的政治痕跡過重,不免有些嚴苛。后來涂爾干等社會理論家進而在此基礎(chǔ)上努力為法國社會的治理尋找新的民情基礎(chǔ)。
[Abstract]:The Theory of Social contract has always been regarded as a political masterpiece, in which Rousseau put forward the famous conclusion that "Life is free, but it always carries its shackles."With the help of social contract, he tried to transform "natural freedom" into "freedom of agreement" politically.The advantage of freedom of agreement rather than freedom of nature lies in the benefits of public will and the political system formed on the basis of public will.Rousseau theoretically guaranteed the legitimacy of the general will, which, by its nature, could not be mistaken.However, as the general will solidifies step by step in practice, its legitimacy almost everywhere faces the risk of loss.In order to prevent the public loss of its legitimacy, Rousseau step by step defensive, in such a hard work.Eventually, he realized that political design alone was not enough to justify the will, and had to rely on public sentiment, so he designed a corresponding "civic religion."But the political vestiges of this civil religion are too heavy to avoid.Later, Durkheim and other social theorists went on to seek a new basis for the governance of French society.
