【摘要】：“公民不服從”理論的研究源于西方,二十世紀(jì)六十年代末到七十年代初這一研究達(dá)到了高潮,而當(dāng)代有關(guān)于“公民不服從”理論研究,應(yīng)該首推羅爾斯在其名著《正義論》中的闡釋。 本文主要研究的是羅爾斯的“公民不服從”理論,主要介紹了羅爾斯公民不服從理論的學(xué)理脈絡(luò)、正義論視角、內(nèi)容、證明以及公民不服從與良心拒絕的區(qū)別,并且在此基礎(chǔ)上深入地分析了羅爾斯這一理論的合理性和局限性。羅爾斯假定“公民不服從”在接近正義的民主制度中存在侵犯正義的兩個(gè)原則的法律或者制度,并且在忠于法律的范圍內(nèi)進(jìn)行的。這一理論有利于糾正社會(huì)的不正義加強(qiáng)維護(hù)社會(huì)的正義制度的作用,同時(shí)它還有助于改善法律制度,促進(jìn)公民自由和權(quán)力的實(shí)現(xiàn);我們還應(yīng)該看到它的局限性,羅爾斯在論證上存在邏輯缺陷而且由于羅爾斯假定在一個(gè)接近正義的社會(huì)中來(lái)討論這一理論的,并且他還強(qiáng)調(diào)這一理論應(yīng)該符合正義的法律,所以一旦將這一理論付諸實(shí)踐就會(huì)遇到很多困難。
[Abstract]:The research on the theory of "citizen disobedience" originated in the West, and reached its climax from the end of 1960s to the beginning of 70s. The explanation of Rawls in his famous book, the Theory of Justice, should be put forward first. This paper mainly studies Rawls' theory of "citizen disobedience", mainly introduces the theoretical context of Rawls' civil disobedience theory, the angle of view of justice, the content, the proof and the difference between citizen disobedience and conscientious objection. On this basis, the rationality and limitation of Rawls' theory are deeply analyzed. Rawls assumes that there are two laws or systems that violate the two principles of justice in a democratic system close to justice. This theory is helpful to correct social injustice and strengthen the function of safeguarding social justice system. At the same time, it also helps to improve the legal system and promote the realization of civil liberties and power. We should also see its limitations, Rawls has logical flaws in his argument and because Rawls assumes to discuss this theory in a society close to justice, and he also stresses that it should conform to the law of justice. So once this theory is put into practice, there will be many difficulties.
