【摘要】：中國(guó)傳統(tǒng)術(shù)治主義的產(chǎn)生,是先秦兵家、道家、縱橫家尤其是法家思想共同凝聚的結(jié)果。作為術(shù)治主義的集大成者,韓非的術(shù)治理論是在君主集權(quán)即將建立之際對(duì)其官僚體制的建構(gòu)及運(yùn)營(yíng)而做出的一次系統(tǒng)闡述,盡管其不乏君本位及陰謀論成分,但主導(dǎo)內(nèi)涵則表現(xiàn)為建立于法治之上的對(duì)官吏進(jìn)行選拔、使用、監(jiān)督和考核的一整套管理體系,本質(zhì)上是試圖建設(shè)規(guī)范政治秩序的一次積極努力。雖然在后世的演變中,其消極的一面壓倒了積極的一面,甚至出現(xiàn)"術(shù)"凌駕于"法"的局面,但其合理性不應(yīng)被長(zhǎng)期忽視。在今日法治松弛、理性缺失、吏弊叢生的社會(huì)情勢(shì)下,傳統(tǒng)術(shù)治主義明法治吏、因能授官、循名責(zé)實(shí)、禁奸止邪等吏治之道,依然具有重要的借鑒價(jià)值。
[Abstract]:The emergence of Chinese traditional technocracy is the result of the conglomeration of the pre-Qin military, Taoist, vertical and horizontal scholars, especially the Legalists. Han Fei's theory of governance is a systematic exposition of the construction and operation of the monarch's bureaucratic system when the monarch's centralization is about to be established, although there is no lack of monarchical standard and conspiracy theory. But the dominant connotation is based on the rule of law on the selection, use, supervision and assessment of a set of management system. In essence, it is an active effort to build a normative political order. Although in the evolution of later generations, its negative side overrides the positive side, and even appears the situation that "skill" prevails over "law". However, its rationality should not be ignored for a long time. In today's social situation where the rule of law is slack, rationality is absent, and officials have numerous disadvantages, the traditional rule of art doctrine shows that officials under the rule of law, because they can teach officials, follow the name of responsibility, prohibit rape and stop evil, and so on. Still have important reference value.
