【摘要】：當(dāng)代正義理論有一條基本的發(fā)展路徑,即從羅爾斯的分配正義理論經(jīng)哈貝馬斯的話語正義理論再到弗雷澤的三維正義理論。而這條路徑發(fā)展和演變的基本邏輯就是:在"什么的正義"問題上,從追求普遍公平的實(shí)質(zhì)正義向追求參與平等的程序正義轉(zhuǎn)變;在"誰的正義"問題上,從追求統(tǒng)一價(jià)值目標(biāo)而采取統(tǒng)一行動(dòng)的代理人、共同體成員或國(guó)家公民向追求多樣化價(jià)值目標(biāo)而進(jìn)行話語交往的多元共同體、公眾或個(gè)體轉(zhuǎn)變;在"如何正義"問題上,從以經(jīng)濟(jì)再分配為根本向以經(jīng)濟(jì)再分配、文化承認(rèn)與政治建構(gòu)并重轉(zhuǎn)變。在正義理論的這一發(fā)展過程中,民主對(duì)于正義的構(gòu)成作用日益凸顯,并成為正義制度合法性的基礎(chǔ)。
[Abstract]:The contemporary justice theory has a basic path of development, namely from Rawls' theory of justice by Habermas's theory of discourse justice to three-dimensional Fraser's theory of justice. And the basic logic of the path of development and evolution is: "what justice", from the pursuit of procedural justice in the pursuit of equality in essence change justice of universal justice; in the "who" justice issues, from the pursuit of unity of value goal and adopt the unified action of multiple agents, community members of the community or citizens of the country to pursue diversification value goal and discourse communication, change the public or individual; in "justice", from the fundamental to economic redistribution with economic redistribution, cultural recognition and political construction of both changes. In the process of development of the theory of justice, democracy and justice for role has become increasingly prominent, and become justice The basis of the legitimacy of the system.
