【摘要】：本文認為在中國古代 ,邊疆的概念有其特定的文化含義。不僅如此 ,邊疆概念還有特定的、不同于西方以主權概念為中心的含義。邊疆概念的這種特殊性質與中國古代特殊的、以漢文化為主體的多民族國家的政治傳統(tǒng)和多元一體的文化格局有關 ,反映在中國古代的立法和司法制度上就是邊疆的法律與邊疆的概念和邊疆的民族之間呈現(xiàn)出一種歷史性的波動和相對穩(wěn)定的統(tǒng)一。作者從這一角度對之進行探討 ,彌補了相關研究的不足
[Abstract]:This paper argues that in ancient China, the concept of frontier has its specific cultural implications. Not only that, the concept of frontier has a specific, different from the western concept of sovereignty as the center of the meaning. The special nature of the frontier concept is related to the political tradition and the pluralistic cultural pattern of the multi-ethnic countries with the Han culture as the main body in ancient China. Reflected in the legislation and judicial system of ancient China, there is a historical fluctuation and a relatively stable unity between the law of the frontier and the concept of the frontier and the nationality of the frontier. From this point of view, the author discusses it and makes up for the deficiency of related research.
