【摘要】：新發(fā)現(xiàn)的吳達海揭帖可以確證吳達海曾為《順治律》上請御制序,而且上請時間是在順治三年正月而非五月。清廷在順治三年對修律宗旨作了改變。吳達海在順治三年正月所呈律典與順治四年頒布的《順治律》是不同修律宗旨下的產物。前者參酌滿、漢,后者則基本復制明律。修律宗旨的變化是《順治律》御制序成于三年五月而《順治律》頒布卻在四年的主要原因。
[Abstract]:The newly discovered Wu Da-hai post can confirm that Wu Dahai was ordered by the imperial ruler on the Shunzhi Law, and the invitation time was in Shunzhi three years, not May. The Qing government changed the tenet of practicing the law in Shunzhi three years. The "Shunzhi Law" issued by Wu Da-hai in Shunzhi three years and Shunzhi four years is the result of different principles. The former refers to the full, Han, the latter is basically copied Ming law. The change of the tenet is the main reason why the imperial order was established in May of three years and the law of Shunzhi was promulgated in four years.
