【摘要】：各地山林在國家賦稅體系中的不同地位,造成山林所有權(quán)確權(quán)方式的差異。無稅山產(chǎn)的確認(rèn)以契約為主要證據(jù),而有稅山林的魚鱗山冊(cè)以及在冊(cè)書手中掌握的私冊(cè),也構(gòu)成了訴訟糾紛中主要的證據(jù)。浙江省龍泉和建德兩縣分別是這兩種情況的典型。因此,民國山林國有化、契稅和不動(dòng)產(chǎn)登記等一系列政策,對(duì)兩地山林的確權(quán)產(chǎn)生了不同的影響。在此過程中,原來以契約為主要確權(quán)憑證的習(xí)慣以及由冊(cè)書把持的、通過升科納糧獲得山林所有權(quán)的方式,都遭到了挑戰(zhàn),國家與山區(qū)民眾之間的關(guān)系也變得更加緊密。
[Abstract]:The different position of mountain forest in the national tax system leads to the difference of the way of confirming the ownership of mountain forest. The confirmation of non-taxable mountain property is mainly based on the contract, and the fishscale mountain book of the taxable mountain forest and the private register held in the register hand also constitute the main evidence in the litigation dispute. Longquan and Jiande counties in Zhejiang Province are typical of these two cases respectively. Therefore, a series of policies, such as nationalization of mountain forest in the Republic of China, deed tax and registration of real estate, have had different influence on the right to confirm the mountain forest between the two places. In the process, the habit of using contract as the main certificate of power confirmation and the way of obtaining the ownership of mountain forest through ascending Kona grain under the control of books were challenged, and the relationship between the country and the people in mountain areas became closer.
