【摘要】：晚清時期的中外條約關系具有畸形法律性質,除了占主導地位的不平等屬性之外,還附帶某些平等屬性的內容。其中整體性平等條約,分為綜合性和具體事項兩大類別,均在強權政治的大背景下曇花一現(xiàn)。各不平等條約中又有著平等性質的條款,在權利義務的約定方面,或給對方規(guī)定相應義務以維護中國的利益,或作對等規(guī)定予以中方某種權利。還有符合近代國家關系及其交往規(guī)則的條款,或承諾尊重中國的領土主權,或對國家間的交往方式和規(guī)則作了規(guī)定。另有司法互助、海難救助、中立性質等方面的條款。這些內容居于附屬地位,未能改變不平等條約關系的本質屬性,但反映了中外關系的發(fā)展趨向。
[Abstract]:The relationship between Chinese and foreign treaties in the late Qing Dynasty had an abnormal legal nature. In addition to the unequal attribute of the dominant position, there were also some contents of the equality attribute. Among them, integral equality treaty, divided into two categories of comprehensive and specific issues, both in the context of power politics short-lived. There are equal provisions in the unequal treaties. In terms of the agreement of rights and obligations, the corresponding obligations are given to the other party in order to safeguard the interests of China, or countervailing and so on to give certain rights to the Chinese side. There are also articles which accord with the modern state relations and their rules of communication, or promise to respect China's territorial sovereignty, or stipulate the ways and rules of communication between countries. There are also mutual legal assistance, salvage at sea, neutrality and other aspects of the provisions. These contents are subordinate and fail to change the nature of unequal treaty relations, but reflect the development trend of Sino-foreign relations.
