【摘要】:正有一種意見認為,《清帝退位詔書》授權(quán)袁世凱組織共和政府,以"禪讓"方式實現(xiàn)了"主權(quán)轉(zhuǎn)移",民國主權(quán)的合法性由此得以實現(xiàn);由于清帝擁有"天下共主"地位,詔書的頒布使中華帝國得以避免同期奧匈帝國似的分裂命運,促成了"五族共和",因而退位詔書實乃建國綱領(lǐng),堪比《臨時約法》。作者認為,這種意見錯漏甚多,須予駁難。作者論證,中華民國是革命建國而非前朝皇帝授權(quán)變
