【摘要】：民初,政府除了頒布《商會(huì)法》,還制定和頒布《工商同業(yè)公會(huì)規(guī)則》,以引導(dǎo)和規(guī)范商人團(tuán)體發(fā)展。然而,因?qū)珪?huì)發(fā)起人資格、公會(huì)名稱等規(guī)定不確,規(guī)則甫經(jīng)公布就爭議不斷,政府不得不進(jìn)行修正。此外,工商界還為爭奪公會(huì)認(rèn)定權(quán)而發(fā)生沖突,政府為發(fā)展工業(yè)則將規(guī)則一分為二,分別制定工業(yè)、商業(yè)兩類公會(huì)規(guī)則。政府通過法律法規(guī)賦予商人團(tuán)體管理商務(wù)職責(zé)的同時(shí),豐富了介入經(jīng)濟(jì)社會(huì)的手段,商人團(tuán)體則憑借法律法規(guī)授權(quán),獲得相對獨(dú)立的經(jīng)濟(jì)社會(huì)治理權(quán),這些構(gòu)成了中國近代社會(huì)治理制度的重要面相。
[Abstract]:In the early days of the Republic of China, in addition to promulgating the law of the chamber of Commerce, the government had enacted and promulgated the rules of the trade and business association to guide and standardize the development of the merchant group. However, because of the inaccuracy of the qualifications of the sponsors and the name of the guild, the rules were published and the government had to be revised. In addition, the industry and Commerce have also been fighting for the right to identify the guild. In order to develop industry, the government divides the rules into two rules, formulating the rules of the two categories of industry and commerce. The government has enriched the means to intervene in the economy and society while the government gives the business responsibility to the businessmen through laws and regulations, and the merchant groups are authorized by the laws and regulations to obtain relatively independent economic and social governance. These constitute the right of economic and social governance. The important face of the modern social governance system in China.
