身體的解放:太平天國(guó)蓄發(fā)、放足令探析

【摘要】:作為太平天國(guó)法律體系的重要組成,蓄發(fā)、放足令在頒布之初得到民眾的積極響應(yīng),為這一新興政權(quán)爭(zhēng)取了廣泛的民意,在此后的推行過(guò)程中卻逐漸遠(yuǎn)離其恢復(fù)漢人傳統(tǒng),解放民眾身體之本旨,打上了政治與強(qiáng)權(quán)的印記,促使這一政權(quán)迅速土崩瓦解。研究這兩項(xiàng)法令,對(duì)于全面、深刻認(rèn)識(shí)太平天國(guó)統(tǒng)治者的施政方略、法律理念具有以小見(jiàn)大的重要意義。文章從五個(gè)部分展開(kāi):第一部分,分析蓄發(fā)令解放男性身體之內(nèi)涵,得出太平天國(guó)頒布蓄發(fā)令的直接原因是對(duì)抗清初厵發(fā)令,而本質(zhì)原因在于體現(xiàn)歸順與征服。第二部分,分析放足令解放女性身體之內(nèi)涵,得出太平天國(guó)頒布放足令直接受到基督教義與客家“天足”習(xí)俗的影響,,而本質(zhì)原因在于倡導(dǎo)婦女參與勞動(dòng)與作戰(zhàn)的傳統(tǒng)。第三部分,對(duì)蓄發(fā)、放足令進(jìn)行比較分析,得出由于在權(quán)力體系中的男女差異,蓄發(fā)令始終推行,放足令中途廢止。第四部分,分析蓄發(fā)令、放足令對(duì)中國(guó)近代剪辮、放足運(yùn)動(dòng)與相關(guān)立法的直接影響。最后,結(jié)語(yǔ)部分一方面對(duì)蓄發(fā)、放足令的歷史意義做簡(jiǎn)要評(píng)價(jià),另一方面說(shuō)明國(guó)家在適用法律改造民眾身體時(shí)應(yīng)當(dāng)保障民眾的基本身體自由。
[Abstract]:As an important part of the legal system of the Taiping Heavenly Kingdom, the law of the Taiping Heavenly Kingdom received a positive response from the public at the beginning of its promulgation, which won wide public opinion for this new regime, but gradually moved away from its restoration of the Han tradition in the course of its implementation. The aim of liberating the people's bodies was marked by politics and power, which led to the rapid collapse of the regime. The study of these two decrees is of great significance to the comprehensive and profound understanding of the governance strategy of the rulers of the Taiping Heavenly Kingdom. The article starts from five parts: in the first part, the author analyzes the order of storing hair to liberate the male body, and draws the conclusion that the direct reason of the Taiping Heavenly Kingdom promulgating the order of storing hair is to resist the order issued in the early Qing Dynasty, but the essential reason lies in the embodiment of obedience and conquest. In the second part, the author analyzes the content of the body of the women, and draws the conclusion that the Taiping Heavenly Kingdom was directly influenced by the Christian meaning and Hakka "Heaven foot" custom, and the essential reason is to advocate the tradition of women's participation in labor and war. In the third part, the author makes a comparative analysis on the order of keeping hair and placing orders, and draws a conclusion that due to the difference between men and women in the power system, the order of keeping hair is carried out all the time, and the order is annulled in the middle of the way. The fourth part analyzes the direct influence of the order of storing hair and placing order on the cutting of braids, the movement of feet and the relevant legislation in modern China. Finally, on the one hand, the conclusion makes a brief evaluation of the historical significance of "storing hair and placing sufficient orders", on the other hand, the state should protect the basic physical freedom of the public when applying the law to reform the public's body.
