【摘要】： 東沙群島自古以來是我國海洋國土,清末被日本人西澤吉次強占,經(jīng)清政府交涉收回。中華民國政府繼續(xù)有效管轄東沙群島,我國漁民也不斷前往開發(fā)資源,其中以1927年至1937年廣東人陳荷朝、馮德安組織的東沙海產(chǎn)公司最具代表性。與此同時,日人也未停止對東沙群島海域的侵?jǐn)_,其強暴行為造成了中國漁民生命財產(chǎn)的巨大損失,也威脅到中國領(lǐng)海主權(quán)完整。對此,中華民國政府向日本進行了長期的交涉,但由于領(lǐng)海制度、綜合國力等原因沒有產(chǎn)生良好的效果。本文通過研究這十年間東沙群島的開發(fā)狀況,力圖展示其歷史原貌,進一步考察民國時期日本對華侵漁狀況、中華民國的領(lǐng)海制度等問題,闡明東沙群島主權(quán)屬我確鑿無疑,強調(diào)對南海諸島問題更應(yīng)注重經(jīng)營開發(fā),希望能對相關(guān)歷史研究及現(xiàn)狀分析有所裨益。
[Abstract]:Dongsha Islands have been the maritime land of China since ancient times, which was seized by the Japanese in the late Qing Dynasty and recovered by the Qing government. The government of the Republic of China continues to effectively administer the Dongsha Islands, and the fishermen of our country continue to develop resources. Among them, Chen he, a Cantonese from 1927 to 1937, was the most representative of the Dongsha Marine Company organized by Feng de'an. At the same time, the Japanese have not stopped harassing the waters of the Dongsha Islands, which has caused huge loss of life and property to Chinese fishermen and threatened the integrity of China's territorial waters. For this reason, the ROC government made long-term representations to Japan, but due to the territorial sea system, comprehensive national strength and other reasons did not produce good results. By studying the development of the Dongsha Islands in the past ten years, this paper tries to show its historical appearance, further investigates the situation of Japanese fishing invasion into China during the Republic of China and the territorial sea system of the Republic of China, and clarifies that the ownership of the Dongsha Islands is beyond doubt. It is emphasized that more attention should be paid to the management and development of the South China Sea islands, and it is hoped that it will be of benefit to the historical research and the analysis of the present situation.
