【摘要】： 近年來(lái),對(duì)陜甘寧邊區(qū)解決糾紛的研究日漸成為中國(guó)近現(xiàn)代史尤其是根據(jù)地史研究的熱點(diǎn)問(wèn)題。本文主要探討抗戰(zhàn)背景下陜甘寧邊區(qū)政府如何解決多元化糾紛,全文共分五個(gè)部分。第一部分為緒論,指出課題研究的意義及檢索以往陜甘寧邊區(qū)政府解決多元化糾紛的研究成果并加以歸納分析。第二部分對(duì)陜甘寧地區(qū)傳統(tǒng)糾紛及解決方式進(jìn)行考察,指出陜甘寧地區(qū)傳統(tǒng)糾紛類(lèi)型、主要解決方式及存在的弊端。第三部分探討陜甘寧邊區(qū)政府解決多元化糾紛的制度構(gòu)建。主要從解決多元化糾紛制度構(gòu)建的必要性和健全司法組織體制及加強(qiáng)立法工作來(lái)進(jìn)行制度構(gòu)建。第四部分是邊區(qū)政府解決多元化糾紛的實(shí)踐。主要包括解決如經(jīng)濟(jì)糾紛、繼承糾紛、婚姻糾紛、民族糾紛、邊界糾紛；人民調(diào)解制度與馬錫五審判方式；歸納解決多元化糾紛的特點(diǎn)。第五部分為陜甘寧邊區(qū)政府解決多元化糾紛的經(jīng)驗(yàn)與啟示。歸納陜甘寧邊區(qū)政府解決多元化糾紛的經(jīng)驗(yàn)及對(duì)當(dāng)前構(gòu)建社會(huì)主義和諧社會(huì)的啟示。
[Abstract]:In recent years, the study of the settlement of disputes in the Shanxi Gansu Ningxia border region has increasingly become a hot issue in the modern history of China, especially the study of geographical history. This paper mainly discusses how the government of the Shaanxi Gansu Ningxia border region solves the diversified disputes in the context of the Anti Japanese War. The full text is divided into five parts. The first part is the introduction, pointing out the significance of the research and searching for the previous Shaanxi Gansu Province. The government of Ningxia border district government to solve the diversification of the dispute and summed up the analysis. The second part of the Shaanxi Gansu Ningxia region traditional disputes and solutions, and pointed out the types of traditional disputes in the Shaanxi Gansu Ningxia region, the main solution and the existing disadvantages. The third part of the Shaanxi Gansu Ningxia border area government to solve the system of multiple disputes system construction. In order to solve the necessity of constructing the Pluralistic Dispute System and perfecting the judicial organization system and strengthening the legislative work, the fourth part is the practice of the border government to solve the diversified disputes, including the solution of economic disputes, inheritance disputes, marital disputes, ethnic disputes, border disputes, and the people's mediation system and Ma Xiwu The fifth part is the experience and Enlightenment of the government in the Shanxi Gansu Ningxia border region to solve the diversified disputes, and summarizes the experience of the government in the Shanxi Gansu Ningxia border region to solve the diversified disputes and the enlightenment to the current construction of a socialist harmonious society.
