【摘要】：四川軍人監(jiān)獄位于重慶土橋申家溝,是南京國民政府遷都重慶后成立的甲種編制、軍政部直轄監(jiān)獄,是國民政府的重要司法執(zhí)行機關(guān),尤其是國民政府遷都重慶后,大量的司法執(zhí)行工作都是由四川軍人監(jiān)獄承擔(dān)。而且軍人監(jiān)獄自身就有其特殊性,所以本研究對于研究民國時期的獄政、司法和社會現(xiàn)實都有一定借鑒。 本文主要分為緒論、正文和結(jié)束語三個部分: 緒論主要闡述了選題的目的及意義、學(xué)術(shù)史回顧以及研究方法的創(chuàng)新之處。 第一章首先明確軍人監(jiān)獄的概念,即是關(guān)押陸�？哲娷娙撕褪艿杰娛虏门械姆擒娙说谋O(jiān)獄,其次講述四川軍人監(jiān)獄的沿革。 第二章主要分析四川軍人監(jiān)獄的組織制度。一共包括三個方面的內(nèi)容:1、四川軍人監(jiān)獄職員的設(shè)置及任用標(biāo)準(zhǔn);2、四川軍人監(jiān)獄職員待遇;3、四川軍人監(jiān)獄對職員的培訓(xùn)和思想控制。 第三章主要分析四川軍人監(jiān)獄的管理體制。一共分為四個方面:1、管理制度;2、監(jiān)獄作業(yè)制度;3、教誨、教育制度;4、基本生活制度。 第四章主要分析四川軍人監(jiān)獄的人犯疏通及釋放制度。主要從四川軍人監(jiān)獄在監(jiān)人犯調(diào)服軍役、調(diào)服勞役、赦免、假釋、保釋等方面論述,并通過具體的案例對在監(jiān)人犯調(diào)服軍役和勞役的情況進行深入分析,借以從側(cè)面揭示抗戰(zhàn)時期調(diào)服兵役的情況。 第五章對在監(jiān)人犯的具體情況進行分析,主要是利用統(tǒng)計方法對在監(jiān)人犯的年齡、職業(yè)、教育程度、疾病及死亡等情況進行詳細(xì)分析,用數(shù)據(jù)說明在監(jiān)人犯的生存狀態(tài)。 第六章對四川軍人監(jiān)獄的建設(shè)和管理提出值得借鑒的經(jīng)驗并對其存在的問題進行反思。 結(jié)束語主要說明四川軍人監(jiān)獄在管理方面做出的努力和經(jīng)驗值得我們借鑒,四川軍人監(jiān)獄在建設(shè)和管理方面存在的問題值得我們深思。
[Abstract]:Sichuan military prison is located in Chongqing Tuqiao Shenjiagou, which was established after the Nanjing National Government moved its capital to Chongqing. The Ministry of military Affairs directly under the prison is an important judicial executive organ of the National Government, especially after the National Government moved its capital, Chongqing. A large number of judicial enforcement work is carried out by the Sichuan military prison. And the military prison itself has its own particularity, so this study for the study of the Republic of China prison, judicial and social reality have certain reference. This paper is divided into three parts: introduction, text and conclusion: The introduction mainly expounds the purpose and significance of the topic, the review of academic history and the innovation of research methods. The first chapter firstly defines the concept of military prison, that is, the prison that holds army, navy and air force servicemen and non-servicemen who are judged by military, and then describes the evolution of Sichuan military prison. The second chapter mainly analyzes the organization system of Sichuan military prison. A total of three aspects of the content: 1, Sichuan military prison staff setting and appointment standards, Sichuan military prison staff treatment, Sichuan military prison staff training and ideological control. The third chapter mainly analyzes the management system of Sichuan military prison. A total of four aspects: 1, management system 2, prison operation system 3, education, education system 4, basic living system. The fourth chapter mainly analyzes the system of prisoner diversion and release in Sichuan military prison. It is mainly discussed from the aspects of transferring military service, transferring labor service, parolement, parole, bail and so on in Sichuan military prison, and through specific cases, it makes an in-depth analysis of the situation of transferring military service and servitude to prison criminals. In order to reveal from the side the situation of the transfer of military service during the War of Resistance against Japan. The fifth chapter analyzes the specific situation of prisoners in prison, mainly uses the statistical method to analyze the age, occupation, education, disease and death of prisoners in detail, and use data to explain the living conditions of prisoners in prison. The sixth chapter puts forward the experience of the construction and management of the military prison in Sichuan province and reflects on the existing problems. The conclusion mainly explains that the efforts and experiences of Sichuan military prisons in management are worth our reference, and the problems in the construction and management of military prisons in Sichuan are worth our thinking.
