【摘要】：出入境管理是一個(gè)國(guó)家范圍內(nèi)的事情,對(duì)外國(guó)人出入境進(jìn)行管理是對(duì)主權(quán)的維護(hù),任何一個(gè)主權(quán)完整的國(guó)家,都有權(quán)對(duì)外國(guó)人出入本國(guó)國(guó)境進(jìn)行管理。外國(guó)人出入境管理,也是一個(gè)國(guó)家對(duì)外交往的一部分。1912年中華民國(guó)建立后,我國(guó)進(jìn)入了民國(guó)時(shí)期。本文研究的內(nèi)容主要是1912年到1949年,也就是民國(guó)時(shí)期,我國(guó)對(duì)外國(guó)人出入境的管理。本文主要涉及以下幾個(gè)方面的內(nèi)容： 第一部分回顧晚清時(shí)期外國(guó)人出入境管理。簡(jiǎn)單介紹1840年以前和1840年之后晚清政府管理外國(guó)人出入境的具體辦法,以及前后的變化。 第二部分論述民國(guó)時(shí)期外人入境管理。該部分包括民國(guó)時(shí)期外國(guó)人出入境管理制度化的背景,外國(guó)人入境,以及重要通商口岸上海的出入境。外國(guó)人入境管理是隨著國(guó)際形勢(shì)和社會(huì)環(huán)境不斷完善和改進(jìn)的。 第三部分以外國(guó)人入境的限制為主要內(nèi)容,分析了在民國(guó)時(shí)期世界其他各國(guó)對(duì)外國(guó)人入境的限制,以及我國(guó)對(duì)外國(guó)人入境的限制,并將二者進(jìn)行簡(jiǎn)單的比較。 第四部分論述外國(guó)人出境管理。主要包括外國(guó)人合法出境、驅(qū)逐或限令出境,外國(guó)難民出境等內(nèi)容。 總的來(lái)說(shuō),民國(guó)時(shí)期的外國(guó)人出入境管理,與鴉片戰(zhàn)爭(zhēng)后清政府的出入境管理相比,具有很大的進(jìn)步。民國(guó)時(shí)期外國(guó)人出入境管理的完善,維護(hù)了我國(guó)的主權(quán)和利益,也是中國(guó)在外交上的重大成就。
[Abstract]:Immigration and entry control is a matter within the scope of a country. The administration of the entry and exit of foreigners is the maintenance of sovereignty. Any country with complete sovereignty has the right to control the entry and exit of foreigners into and out of its territory. After the founding of the Republic of China in 1912, China entered the period of the Republic of China. The contents of this paper are mainly from 1912 to 1949, that is, the period of the Republic of China. This paper mainly deals with the following aspects:. The first part reviews the immigration administration of foreigners in the late Qing Dynasty. It briefly introduces the specific methods and changes of the government before 1840 and after 1840 in managing the entry and exit of foreigners. The second part discusses the entry management of foreigners in the period of the Republic of China, which includes the background of the institutionalization of the entry and exit management of foreigners during the period of the Republic of China, As well as the entry and exit of Shanghai, an important trade port, the management of foreigners' entry has been improved with the development of international situation and social environment. In the third part, the author analyzes the restrictions on the entry of foreigners in other countries in the Republic of China, as well as the restrictions on the entry of foreigners in China, and makes a simple comparison between the two. Part 4th deals with the administration of the exit of foreigners. It mainly includes the legal exit of foreigners, expulsion or restriction, and the departure of foreign refugees. In general, the administration of entry and exit of foreigners during the Republic of China period, compared with the immigration administration of Qing government after the Opium War, has made great progress. The perfection of the administration of entry and exit of foreigners during the period of the Republic of China has safeguarded the sovereignty and interests of our country. It is also a major diplomatic achievement for China.
