【摘要】：中國史學(xué)家圍繞著治外法權(quán)問題對于第一次鴉片戰(zhàn)后的外交談判過程進(jìn)行了認(rèn)真研究,基本認(rèn)定是耆英等人將中國的治外法權(quán)拱手相讓,但沒有進(jìn)一步探討其歷史淵源。事實(shí)上,從唐朝開始,歷經(jīng)宋、元、明、清一千余年,中國歷代皇朝對待外國僑民的政策是一脈相承,或者設(shè)立蕃坊,或者設(shè)立商館,總是設(shè)法預(yù)防華夷雜處,無不要求外國僑民聚居在一起,試圖將華人與夷人隔離起來。并且對于聚居的外國僑民總是采取"因俗而治"的辦法,賦予外國僑民相當(dāng)大的自治權(quán)利。這種"以不治治之"的"華夷分治"觀念根深蒂固,對于耆英、宮慕久等人的外交思想和活動(dòng)產(chǎn)生了比較大的影響。
[Abstract]:Chinese historians have studied the process of diplomatic negotiation after the first opium war around the issue of extraterritorial jurisdiction, and basically concluded that it was the Senior Citizen and others who ceded their hands to China's extraterritorial power. In fact, from the Tang Dynasty, after the Song, Yuan, Ming and Qing dynasties more than 1,000 years, the Chinese imperial dynasties to treat foreign nationals in a single line of policy, or the establishment of Fan Fang. Or set up a business hall, always try to prevent the Chinese mixed places, all the foreigners are required to live together, trying to separate the Chinese from the foreigners, and for the foreign diaspora always take the method of "according to custom and governance." The idea of "partition of China and Yi" is deeply rooted, which has a great influence on the diplomatic thoughts and activities of such people as Senior Citizen and Gong Mu.
