【摘要】： 家庭是社會生活的基本單位,本文主要借鑒社會學上的概念和理論,對北朝時期的家庭進行了多方面的考察。首先劃分了當時家庭的基本類型,并系統(tǒng)論述了影響北朝家庭規(guī)模結構的諸種因素。其次對于家庭成員的地位與義務進行了闡述,指出胡、漢家庭存在的種種差別。接下來探討了建立在乳養(yǎng)、收養(yǎng)、過繼等基礎上的擬制親屬關系,以及他們之間的權利和義務。在此基礎上,從行政法和刑法兩個角度,對親屬關系在法律上產生的效力予以闡釋。認為這種效力不僅及于依婚姻血緣關系自然產生的親屬,也涉及擬制的血親,但以五服內的父系宗親為主。最后,從家庭功能著眼,對北朝時期各個階層家庭的收支與管理,宗教信仰情況,和家庭教育分別進行考察,揭示在不同階級、階層,民族、種族之間存在的細微差別,以便從各個角度展示北朝家庭的整體面貌。
[Abstract]:Family is the basic unit of social life. At first, the basic types of families were divided, and the factors influencing the family size of the Northern Dynasty were systematically discussed. Secondly, the status and obligations of family members are expounded, and the differences between Hu and Han families are pointed out. Then it discusses the fictitious kinship relationship and their rights and obligations on the basis of nursing, adoption and adoption. On this basis, from the two angles of administrative law and criminal law, the legal effects of kinship are explained. It is considered that this kind of effect is not only related to the natural relatives who are related to marriage, but also to fictitious blood relatives, but mainly to the paternal relatives in the five services. Finally, from the perspective of family function, this paper investigates the income and expenditure and management, religious beliefs, and family education of families of different classes, strata, nationalities and races in the Northern Dynasty, and reveals the subtle differences between different classes, strata, nationalities and races. In order to show the whole face of the Northern Dynasty family from various angles.
