【摘要】:本文以《大清律例》為中心,通過對清代法律控制的主體、客體與控制方法、控制內(nèi)容的研究,探索清代的法律控制與社會(huì)控制的關(guān)系,揭示《大清律例》在清代社會(huì)中的作用。著重回答三個(gè)問題,即《大清律例》在清代社會(huì)控制中發(fā)揮什么作用、通過何種主體發(fā)揮作用以及怎樣發(fā)揮作用。 社會(huì)控制就是基于一定規(guī)范的社會(huì)秩序的確立和維護(hù)。任何形態(tài)的社會(huì)的正常存在和發(fā)展,都需要社會(huì)調(diào)整和社會(huì)秩序,需要通過一定的物質(zhì)或精神力量使人們遵從社會(huì)權(quán)威,遵守一定的社會(huì)規(guī)范和行為模式,尊重和維護(hù)社會(huì)秩序與社會(huì)價(jià)值,這就是社會(huì)控制的過程。但是,在不同的社會(huì)與歷史發(fā)展階段,社會(huì)控制的方式和手段是不同的。從早期人類社會(huì)的禁忌、習(xí)慣,到后來的道德、宗教、法律、行政等等,都在社會(huì)控制的過程中發(fā)揮著一定的作用。在日趨增多的控制方式中,法律的作用與地位也日趨凸顯,逐漸成為最權(quán)威、最有力、也最為有效的社會(huì)控制手段或工具。 同樣,在中國封建社會(huì)里,幾乎每一個(gè)王朝都將統(tǒng)治秩序和社會(huì)穩(wěn)定作為最主要的社會(huì)控制目標(biāo),甚至是唯一的目標(biāo),法律從來都是以皇權(quán)為中心的社會(huì)控制手段。清朝是中國封建社會(huì)最后一個(gè)王朝,它的政權(quán)是一個(gè)以少制多的少數(shù)民族政權(quán),又處于中國封建社會(huì)發(fā)展的末期,是封建社會(huì)的政治、經(jīng)濟(jì)、社會(huì)各
[Abstract]:Based on the study of the subject, object and method of legal control in the Qing Dynasty, this paper explores the relationship between the legal control of the Qing Dynasty and the social control through the study of the subject, object and control method of the legal control in the Qing Dynasty. To reveal the role of Qing laws and regulations in the Qing society. Three questions are emphatically answered, that is, what role the Qing Dynasty laws and regulations play in the social control of the Qing Dynasty, which main body plays its role and how to play its role. Social control is the establishment and maintenance of social order based on certain norms. The normal existence and development of any form of society requires social adjustment and social order. It is necessary to make people comply with social authority, abide by certain social norms and behavior patterns through certain material or spiritual strength. Respect and safeguard social order and social value, this is the process of social control. However, in different stages of social and historical development, the ways and means of social control are different. From taboos and habits in early human society to morality, religion, law, administration and so on, they play a certain role in the process of social control. In more and more ways of control, the role and status of law is becoming more and more prominent, gradually becoming the most authoritative, the most powerful, and the most effective means or tools of social control. Similarly, in the feudal society of China, almost every dynasty regards the ruling order and social stability as the most important goal of social control, even the only goal, and the law has always been the means of social control centered on imperial power. The Qing Dynasty is the last dynasty of Chinese feudal society, its regime is a minority regime with less system and more, and it is also in the end of the development of Chinese feudal society. It is the politics, economy and society of feudal society.
