【摘要】：租佃實(shí)現(xiàn)勞動(dòng)力與土地相結(jié)合,推動(dòng)農(nóng)業(yè)生產(chǎn)的一種重要形式。佃農(nóng)按約定向地主交租,但在災(zāi)年,減租成為兩者爭(zhēng)訴焦點(diǎn)。在乾隆朝,減租政策與習(xí)慣相沖突。在價(jià)值上,政策維護(hù)國(guó)家利益,而習(xí)慣維護(hù)社會(huì)公平。在規(guī)則上,政策不強(qiáng)制地主減租,而習(xí)慣允許佃農(nóng)減租;政策對(duì)減租比例無(wú)明確規(guī)定,而習(xí)慣有比較清晰規(guī)定;政策規(guī)定由政府認(rèn)定減租,而習(xí)慣規(guī)定由地主認(rèn)定減租。兩者抵觸不僅導(dǎo)致減租司法混亂,而且激化租佃矛盾,使佃農(nóng)暴力減租成為常態(tài),引發(fā)社會(huì)震蕩,并惡化農(nóng)業(yè)生產(chǎn)。
[Abstract]:Tenancy realizes the combination of labor and land, promoting an important form of agricultural production.Tenants pay their rents to landlords as agreed, but rent reduction became the focus of litigation in the year of disaster.During the Qianlong Dynasty, rent reduction policies conflicted with habits.In value, policy upholds national interests, while habit upholds social equity.In the rule, the policy does not force the landlord to reduce the rent, but the custom allows the tenant to reduce the rent; the policy has no explicit stipulation on the proportion of the rent reduction, but the habit has the clearer stipulation; the policy stipulation is decided by the government to reduce the rent, but the custom stipulation is decided by the landlord to reduce the rent.The conflict not only leads to judicial confusion of rent reduction, but also intensifies the contradiction of tenancy, makes violent rent reduction among tenants become the norm, causes social shock, and worsens agricultural production.
