【摘要】：正封建鼎盛時(shí)期的唐代,針對(duì)已經(jīng)出現(xiàn)的各類民事糾紛,封建統(tǒng)治階級(jí)開始將賠償寫進(jìn)法典。以"一準(zhǔn)乎理,得古今之平"著稱于世的《唐律疏議》,盡管受時(shí)代和階級(jí)的局限,賠償只在有限的范圍內(nèi)進(jìn)行,但是其規(guī)定卻很是條理詳細(xì),堪稱是開創(chuàng)了我國民事法律賠償機(jī)制的先河,直接為后世宋元明清統(tǒng)治者沿襲。以古為鑒,《唐律疏議》中關(guān)于賠償問題的規(guī)定,在今天依舊有很多值得借鑒的地方。一、唐代重要的牛馬等生產(chǎn)工具的賠償
[Abstract]:In the Tang Dynasty, at the height of feudalism, the feudal ruling class began to write compensation into the code in response to the various civil disputes that had already appeared. The Tang Law, known as "the right to be reasonable, to get the balance of ancient and modern times," was noted in the Tang Dynasty, despite the limitations of the times and classes. Compensation is only carried out within a limited scope, but its provisions are very methodical and detailed, which can be regarded as the pioneer of the civil legal compensation mechanism of our country. It is directly followed by the rulers of the Song, Yuan, Ming and Qing dynasties of later generations. Taking the ancient times as a mirror, the provisions on compensation in the "Tang Law sparsely discussed" still have a lot to learn from today. First, the compensation of important production tools such as cattle and horses in the Tang Dynasty.
