【摘要】：雙邊投資保護(hù)協(xié)定是各國(guó)保護(hù)企業(yè)海外投資利益的重要工具,也是中國(guó)構(gòu)建海外投資利益保護(hù)機(jī)制的核心與關(guān)鍵內(nèi)容。當(dāng)前,中國(guó)與"一帶一路"沿線(xiàn)國(guó)家之間的雙邊投資保護(hù)協(xié)定多是上世紀(jì)八九十年代簽訂的,這一時(shí)期中國(guó)主要從投資東道國(guó)立場(chǎng)出發(fā),締結(jié)的雙邊投資保護(hù)協(xié)定內(nèi)容較為保守與謹(jǐn)慎,對(duì)投資者提供的投資保護(hù)程度相對(duì)較低。中國(guó)當(dāng)前亟須與相關(guān)的"一帶一路"國(guó)家啟動(dòng)雙邊投資保護(hù)協(xié)定的"升級(jí)"談判,并在對(duì)中國(guó)與"一帶一路"國(guó)家雙向投資的實(shí)際情況及潛在趨勢(shì)進(jìn)行定量和定性評(píng)估基礎(chǔ)上締結(jié)"平衡范式"的雙邊投資保護(hù)協(xié)定。
[Abstract]:Bilateral investment protection treaty is an important tool for countries to protect the interests of overseas investment of enterprises. It is also the core and key content of China's construction of overseas investment interest protection mechanism. At present, most bilateral investment protection agreements between China and countries along the route of "Belt and Road" were signed in the 1980s and 1990s. During this period, China mainly set out from the standpoint of the host country of investment. The contents of bilateral investment protection agreements are conservative and cautious, and the degree of investment protection to investors is relatively low. China is in urgent need of launching "upgrading" negotiations on bilateral investment protection agreements with relevant "Belt and Road" countries. On the basis of quantitative and qualitative evaluation of the actual situation and potential trend of two-way investment between China and Belt and Road, a "balanced paradigm" bilateral investment protection agreement is concluded.
