【摘要】："一帶一路"倡議為全球經(jīng)濟(jì)合作與互惠發(fā)展提供了良好的平臺與規(guī)則導(dǎo)向,不僅有助于引導(dǎo)我國全面調(diào)整經(jīng)濟(jì)結(jié)構(gòu),而且有助于推動全球經(jīng)濟(jì)秩序重建。過境自由作為"一帶一路"倡議下國際貿(mào)易貫通的基礎(chǔ)與制度保障,對提升物流效率和貿(mào)易效率、實(shí)現(xiàn)交通運(yùn)輸自由暢通具有異常關(guān)鍵的作用。然而,目前盡管相關(guān)國際公約給予了過境自由一定的規(guī)則保障,但受利益沖突、法律規(guī)則認(rèn)同差異、產(chǎn)業(yè)保護(hù)盛行、各國間政治角逐等因素影響,在過境自由方面仍然存在制度差異、海關(guān)通關(guān)效率低、基礎(chǔ)設(shè)施不統(tǒng)一、政治風(fēng)險(xiǎn)高等一系列問題。為推動和保障過境自由制度的順利實(shí)施,我國一定要積極發(fā)揮重要作用,采取有效措施,督促沿線各國與世界貿(mào)易組織規(guī)則保持一致;主導(dǎo)簽署海關(guān)合作備忘錄;簽訂國際投資協(xié)定,促進(jìn)基礎(chǔ)設(shè)施建設(shè);主導(dǎo)簽訂地區(qū)性自由貿(mào)易協(xié)定(RTA),建立自由貿(mào)易區(qū)。
[Abstract]:The "Belt and Road" initiative provides a good platform and rule-oriented for global economic cooperation and mutually beneficial development. It is not only helpful to guide our country to adjust the economic structure in an all-round way, but also to promote the reconstruction of the global economic order. As the foundation and system guarantee of international trade under Belt and Road initiative, transit freedom plays a very important role in improving logistics efficiency and trade efficiency, and realizing the freedom of transportation. However, although relevant international conventions guarantee the freedom of transit to a certain extent, they are affected by conflicts of interest, differences in the identification of legal rules, the prevalence of industrial protection, political rivalry among countries, and so on. There are still a series of problems in the freedom of transit, such as low efficiency of customs clearance, disunity of infrastructure, high political risk and so on. In order to promote and guarantee the smooth implementation of the system of freedom of transit, China must actively play an important role, take effective measures to urge countries along the route to maintain consistency with the rules of the World Trade Organization, and take the lead in signing memorandums on customs cooperation. International investment agreements are signed to promote infrastructure construction, and regional free trade agreements (RTA) are signed to establish free trade zones.
