【摘要】：隨著全球經(jīng)濟(jì)的發(fā)展,各國對能源的需求量正在攀升,海外能源投資成為爭取能源資源、實(shí)現(xiàn)資本價(jià)值的有效方式。為解決國內(nèi)能源供求關(guān)系的矛盾,我國也踴躍開展海外能源投資,一方面獲取能源資源彌補(bǔ)國內(nèi)能源供應(yīng)的短缺,另一方面輸出新能源技術(shù)獲得豐厚投資資本回報(bào)。在頻繁的國際投資過程中,發(fā)生各種摩擦和爭端在所難免,怎樣利用有關(guān)法律手段,保護(hù)我國海外能源投資的安全,維護(hù)能源企業(yè)的合法權(quán)益,成為一個(gè)迫切的問題。加強(qiáng)我國海外能源投資保護(hù)法律困境和對策的研究,對推動我國開展國際能源合作與投資,尤其是在“一帶一路”戰(zhàn)略下我國開展與東南亞、中亞、中東等地區(qū)和俄羅斯等國家的能源合作與投資具有重大意義。本文結(jié)合“一帶一路”戰(zhàn)略,分析我國在海外能源投資中遭遇的困境,通過對國際能源合作組織以及鄰近國家能源投資政策和法律的分析和比較,探討海外能源投資保護(hù)的法律問題,提出在“一帶一路”戰(zhàn)略背景下我國海外能源投資保護(hù)的法律對策。全文共分四章:第一章簡要介紹“一帶一路”戰(zhàn)略、海外能源投資的概念,分析“一帶一路”戰(zhàn)略帶給我國海外能源投資的機(jī)遇和挑戰(zhàn),引出在這一國家戰(zhàn)略下我國海外能源投資法律保護(hù)的重要意義。第二章主要介紹現(xiàn)階段我國海外能源投資的情況及其特點(diǎn),分析我國海外能源投資面臨的特殊問題,深入剖析我國海外能源投資法律保護(hù)遭遇的困境。第三章著重概括全球性能源合作組織和區(qū)域性經(jīng)濟(jì)合作組織以及發(fā)達(dá)國家對能源投資保護(hù)的法律制度,分析對比各組織和國家法律保護(hù)制度的利弊,歸納整理出可供我國海外能源投資法律保護(hù)借鑒的先進(jìn)經(jīng)驗(yàn)。第四章探討加強(qiáng)“一帶一路”戰(zhàn)略下我國海外能源投資法律保護(hù)的對策,提出完善海外能源投資保護(hù)的法律制度的思路,對以后我國與“一帶一路”沿線國家以及其他能源大國開展更深入合作提供較好的啟發(fā)和借鑒。
[Abstract]:With the development of global economy, the demand for energy is rising. Overseas energy investment has become an effective way to strive for energy resources and realize the value of capital. In order to solve the contradiction between domestic energy supply and demand, our country also enthusiastically launched overseas energy investment, on the one hand, to obtain energy resources to make up for the shortage of domestic energy supply, on the other hand, to export new energy technology to obtain rich return on investment capital. In the process of frequent international investment, all kinds of frictions and disputes are inevitable. How to make use of the relevant legal means to protect the security of our country's overseas energy investment and to safeguard the legitimate rights and interests of energy enterprises has become an urgent problem. To strengthen the research on the legal dilemma and countermeasures of overseas energy investment and protection in China, and to promote China's international energy cooperation and investment, especially under the strategy of "Belt and Road", China will carry out cooperation with Southeast Asia and Central Asia. Energy cooperation and investment in regions such as the Middle East and Russia are of great significance. Based on Belt and Road's strategy, this paper analyzes the difficulties encountered by China in overseas energy investment, and analyzes and compares the energy investment policies and laws of the International Energy Cooperation Organization (IECO) and neighboring countries. This paper probes into the legal problems of overseas energy investment protection, and puts forward the legal countermeasures of overseas energy investment protection in China under the background of "Belt and Road" strategy. The thesis is divided into four chapters: the first chapter briefly introduces Belt and Road's strategy, the concept of overseas energy investment, and analyzes the opportunities and challenges brought to our country's overseas energy investment. The significance of legal protection of overseas energy investment in China under this national strategy is brought forward. The second chapter mainly introduces the current situation and characteristics of China's overseas energy investment, analyzes the special problems faced by our country's overseas energy investment, and deeply analyzes the difficulties encountered in the legal protection of our country's overseas energy investment. The third chapter focuses on summarizing the legal systems of global energy cooperation organizations, regional economic cooperation organizations and developed countries on the protection of energy investment, and analyzes and compares the advantages and disadvantages of various organizations and national legal protection systems. Summing up the advanced experience that can be used for reference in legal protection of overseas energy investment in China. The fourth chapter discusses the countermeasures to strengthen the legal protection of China's overseas energy investment under the strategy of "Belt and Road", and puts forward the idea of perfecting the legal system of overseas energy investment protection. It provides a good inspiration and reference for further cooperation between China and other countries along Belt and Road and other major energy countries.
