【摘要】：隨著全球經(jīng)濟(jì)一體化進(jìn)程和“一帶一路”建設(shè)的推進(jìn),對外匯的有效監(jiān)管顯得越來越重要。近年來,為適應(yīng)國家深化改革、簡政放權(quán)和風(fēng)險(xiǎn)防范的需要,外匯監(jiān)管方式發(fā)生了很大的變化,逐漸由規(guī)則監(jiān)管為主向原則監(jiān)管為主轉(zhuǎn)變,“展業(yè)三原則”即“了解客戶、了解業(yè)務(wù)、盡職審查”被逐漸引入到我國外匯管理領(lǐng)域。以貨物貿(mào)易改革、服務(wù)貿(mào)易改革、自貿(mào)區(qū)外匯管理試點(diǎn)等為代表的外匯管理法規(guī),均突出強(qiáng)調(diào)銀行的盡職審查義務(wù),體現(xiàn)出逐步減少甚至摒棄前置性、規(guī)則性條款,而要求銀行按照“展業(yè)三原則”進(jìn)行審核的政策意圖�！罢箻I(yè)三原則”的應(yīng)用解決了外匯規(guī)則監(jiān)管時(shí)期管理上剛性有余、彈性不足的缺陷,有利于提升外匯管理框架的穩(wěn)定性和應(yīng)對形勢變化及改革發(fā)展的靈活性。但監(jiān)管方式轉(zhuǎn)變過程中,也暴露出部分突出問題:如銀行對“展業(yè)三原則”執(zhí)行不力,審核走過場,甚至迎合企業(yè)需求創(chuàng)新創(chuàng)新產(chǎn)品,助推企業(yè)規(guī)避監(jiān)管;外匯監(jiān)管部門缺乏配套制度和案例指引,面臨取證難、定性難和處罰難等。目前,與“展業(yè)三原則”相配套的政策和管理措施尚未成型,監(jiān)管手段仍需完善,實(shí)現(xiàn)“展業(yè)三原則”在外匯管理領(lǐng)域的真正落地顯得日趨重要和緊迫。本文首先闡述了國內(nèi)外在委托代理關(guān)系理論、銀行監(jiān)管及“展業(yè)三原則”方面的研究。其次描述了“展業(yè)三原則”在國內(nèi)的監(jiān)管現(xiàn)狀。三是列舉了國外“展業(yè)三原則”監(jiān)管的先進(jìn)經(jīng)驗(yàn)。四是對近3年來外匯管理領(lǐng)域查處銀行未切實(shí)履行“展業(yè)三原則”的典型案例,通過個(gè)案研究法、深入訪談法和問卷調(diào)查法,剖析外匯監(jiān)管中存在的問題及其產(chǎn)生的原因。五是針對“展業(yè)三原則”架構(gòu)下我國外匯監(jiān)管存在的問題,借鑒國外先進(jìn)的監(jiān)管經(jīng)驗(yàn),提出相關(guān)對策和建議。
[Abstract]:With the progress of global economic integration and the construction of Belt and Road, the effective supervision of foreign exchange becomes more and more important. In recent years, in order to meet the needs of deepening the reform of the country, simplifying the power of administration and preventing risks, the mode of foreign exchange supervision has changed greatly, and gradually the mode of foreign exchange supervision has changed from the rule supervision to the principle supervision. Know the business, due diligence "is gradually introduced into the field of foreign exchange management in China." The foreign exchange management laws and regulations, such as the reform of trade in goods, the reform of trade in services, the pilot project of foreign exchange management in the free trade area, all highlight the due diligence obligations of banks, which reflect the gradual reduction or even abandonment of the pre-existing and regular provisions, And the policy intention that requires the bank to carry out the audit according to the "three principles of exhibition". The application of the "three principles" solves the defects of more rigid and less flexible management in the period of supervision of foreign exchange rules, which is conducive to promoting the stability of the foreign exchange management framework and the flexibility of coping with the changes of the situation and the reform and development. However, in the process of changing the mode of supervision, some outstanding problems are also exposed: such as the weak implementation of the "three principles of exhibition" by banks, the examination and approval of formality, and even meeting the needs of enterprises to innovate and innovate products to help enterprises evade supervision; The foreign exchange supervision department lacks the supporting system and the case guide, and faces the difficulty of obtaining evidence, defining the nature and punishing, etc. At present, the policies and management measures matched with the "three principles of exhibition" have not yet taken shape, and the means of supervision still need to be perfected. It is increasingly important and urgent to realize the "three principles of exhibition" in the field of foreign exchange management. In this paper, the principal-agent relationship theory, bank supervision and the "three principles of development" are first expounded at home and abroad. Secondly, it describes the present situation of the three principles of exhibition industry in China. Third, it enumerates the advanced experience of the supervision of the three principles of exhibition industry abroad. The fourth is to investigate and deal with the typical cases in the field of foreign exchange management in the past three years, and analyze the existing problems and the causes of the foreign exchange supervision through case study, in-depth interview and questionnaire survey. Fifthly, aiming at the problems existing in China's foreign exchange supervision under the framework of the "three principles of exhibition industry", this paper draws lessons from foreign advanced regulatory experience and puts forward relevant countermeasures and suggestions.
