【摘要】："一帶一路"倡議的提出與推進(jìn),給我國(guó)電子商務(wù)的發(fā)展帶來(lái)了難得的機(jī)遇,但由于網(wǎng)絡(luò)購(gòu)物具有的特殊性,使得網(wǎng)絡(luò)消費(fèi)者的權(quán)益保護(hù)面臨著更大的挑戰(zhàn)。在網(wǎng)絡(luò)購(gòu)物中,網(wǎng)絡(luò)消費(fèi)者的弱勢(shì)地位更顯突出,其知情權(quán)、公平交易權(quán)、交易安全權(quán)、無(wú)理由退貨權(quán)更易受到侵犯,求償權(quán)實(shí)現(xiàn)更加困難。由此,有必要強(qiáng)化網(wǎng)絡(luò)消費(fèi)者知情權(quán)、公平交易權(quán)、交易安全權(quán)、無(wú)理由退貨權(quán)的法律保護(hù)措施,如建立第三方信譽(yù)評(píng)價(jià)機(jī)構(gòu)對(duì)網(wǎng)絡(luò)經(jīng)營(yíng)者進(jìn)行信譽(yù)評(píng)價(jià)制度、以非窮盡的方式列舉對(duì)網(wǎng)絡(luò)消費(fèi)者"不公平、不合理"格式條款的具體情形等,并保障網(wǎng)絡(luò)消費(fèi)者求償權(quán)的實(shí)現(xiàn),如實(shí)行第三方交易平臺(tái)經(jīng)營(yíng)者先行賠付制度、建立網(wǎng)絡(luò)購(gòu)物在線糾紛解決機(jī)制等。
[Abstract]:The proposal of "Belt and Road" has brought a rare opportunity to the development of electronic commerce in China. However, because of the particularity of online shopping, the protection of the rights and interests of online consumers is facing a greater challenge. In the network shopping, the weak position of the network consumer is more prominent, its right to know, the right to fair trade, the right to trade security, the right to return goods without reason is more vulnerable to infringement, and the realization of the claim right is more difficult. Therefore, it is necessary to strengthen the legal protection measures such as the right of network consumers to know, the right to fair trade, the right to trade security, the right to return goods without reason, such as the establishment of a system of reputation evaluation for network operators by third-party credit evaluation agencies. To enumerate in a non-exhaustive manner the specific circumstances of "unfair and unreasonable" format terms to network consumers, and to guarantee the realization of network consumers' right to claim compensation, such as the implementation of the third-party trading platform operator's advance payment system, Establish online online dispute resolution mechanism for online shopping.
