【摘要】："一帶一路"建設(shè)為國際法治提供了新的發(fā)展機遇,這包括:"一帶一路"推進落實實踐"共同體法治"的新理念,"一帶一路"推進探索全球法治的新范式,"一帶一路"開辟了全面一體化發(fā)展的法治新路徑,"一帶一路"催生公正、高效的法治公共新產(chǎn)品。國際法治的要求也給"一帶一路"建設(shè)帶來新課題,這包括:由單方倡議上升為一體化行動的新課題,對接、協(xié)調(diào)與整合現(xiàn)有體制平臺的新課題,多樣化的國內(nèi)法治與國際法治對接的新課題,跨國爭端解決的新課題。"一帶一路"建設(shè)必須建立"合法治性"的思維方式和推進向度,實現(xiàn)與國際法治的對接與契合,這包括:融入與促進現(xiàn)有國際規(guī)則體系的完善,推動建立多元溝通的體制機構(gòu)安排,統(tǒng)籌構(gòu)建以制度統(tǒng)一和相互認可為基礎(chǔ)的一體化機制,妥善利用政治、法律方法解決跨國爭端糾紛。
[Abstract]:The construction of "Belt and Road" has provided a new development opportunity for the international rule of law. This includes: "Belt and Road" promotes the implementation of the new concept of "community rule of law", "Belt and Road" advances the exploration of a new paradigm of the global rule of law, "Belt and Road" opens up a new path of the rule of law for the comprehensive and integrated development, and "Belt and Road" gives birth to justice. Efficient public products of rule of law. The requirements of the international rule of law have also brought new topics to the construction of "Belt and Road", which include: from a unilateral initiative to a new topic of integrated action, a new task of docking, coordinating and integrating existing institutional platforms, The diversification of the domestic rule of law and the international rule of law is a new topic, and a new topic of transnational dispute settlement. " Belt and Road's construction must establish the way of thinking and advancing direction of "legal governance", and realize the docking and correspondence with the international rule of law, which includes: integrating and promoting the perfection of the existing system of international rules. We should promote the establishment of institutional and institutional arrangements for pluralistic communication, co-ordinate the establishment of an integrated mechanism based on institutional unity and mutual recognition, and properly utilize political and legal methods to resolve disputes over transnational disputes.
