【摘要】：部分國(guó)際組織和海運(yùn)大國(guó)支持國(guó)際海運(yùn)船舶配備私人武裝保安,防衛(wèi)近年多發(fā)的海上暴力行為,彌補(bǔ)軍隊(duì)護(hù)航的局限性。我國(guó)"一帶一路"背景下,國(guó)際海運(yùn)安全問(wèn)題愈發(fā)重要,海上私人武裝保安護(hù)航制度必要性凸顯,但我國(guó)私人武裝保安實(shí)踐的空間非常有限。2015年,我國(guó)海事局出臺(tái)《私人武裝保安在船護(hù)航證明簽發(fā)管理辦法》,允許我國(guó)國(guó)際海運(yùn)船舶配備私人武裝保安,這是一個(gè)新的契機(jī)。下一步應(yīng)當(dāng)通過(guò)制定海上私人武裝保安使用規(guī)范、完善船長(zhǎng)管理制度等措施解決該《辦法》的不足,同時(shí)應(yīng)處理好使用海上私人武裝與維護(hù)國(guó)際關(guān)系的問(wèn)題。
[Abstract]:Some international organizations and major maritime countries support that international maritime vessels be equipped with private armed security to defend against the frequent acts of violence at sea in recent years and make up for the limitations of military escort.Under the background of Belt and Road, the international maritime security is becoming more and more important, and the necessity of private armed security escort system at sea is prominent, but the practice of private armed security in China is very limited.The Administration of Maritime Affairs of our country has issued the regulations on the issuance of the certificate of escort for private armed security vessels, which allows China's international maritime vessels to be equipped with private armed security guards, which is a new opportunity.The next step should be to solve the shortage of this method by formulating the rules for the use of private armed security at sea and perfecting the management system of the captain. At the same time, the problems of the use of private armed forces at sea and the maintenance of international relations should be handled well.
