【摘要】："一帶一路"戰(zhàn)略構(gòu)想以國家間的創(chuàng)新合作為主要模式。在該戰(zhàn)略的推進過程中,資金流通是一個重要的方面,人民幣國際化的推動是實現(xiàn)資金流通的重要進程,其中資本項目的開放是貨幣國際化的基本要求及不可或缺的環(huán)節(jié)。在這樣的歷史進程中,我國證券市場相關(guān)制度在迅速的對外開放與變革中面臨各方面的風(fēng)險與矛盾。本文通過對歷史與現(xiàn)狀的闡述,分析我國資本項目開放過程中證券市場存在的投資者保護、交易制度、跨國風(fēng)險管控等制度缺陷,對未來的制度變革提出一系列建議,旨在促進我國證券市場的法律制度完善,從而更好地實現(xiàn)對外開放中的跨境資金流通活動,抓住開放帶來的機遇,為應(yīng)對開放帶來的壓力和風(fēng)險做好準備。
[Abstract]:Belt and Road's strategic concept is based on innovative cooperation among countries. In the process of promoting the strategy, the circulation of funds is an important aspect, and the promotion of RMB internationalization is an important process to realize the circulation of funds. The opening of capital account is the basic requirement and indispensable link of currency internationalization. The related system of China's securities market is facing various risks and contradictions in the rapid opening to the outside world and reform. This paper analyzes the investor protection in the process of opening up the capital account in China by expounding the history and the present situation. Trading system, transnational risk control and other institutional defects, put forward a series of suggestions for the future institutional changes in order to promote the perfection of the legal system of China's securities market, so as to better realize the cross-border capital circulation activities in opening up to the outside world. Seize the opportunities of openness and prepare for the pressures and risks of openness.
