【摘要】：公元前31年亞克興海戰(zhàn)打敗安東尼后,屋大維建立了羅馬帝國,成為國家的最高統(tǒng)治者。在帝國建立之初,屋大維開始著手政治、經(jīng)濟(jì)、文化、法律等方面的一系列改革。奧古斯都道德法就是這些諸多改革中的重要組成部分。自公元前3世紀(jì)以來,隨著與外界不斷地交流,羅馬昔日樸素傳統(tǒng)的道德觀念一去不復(fù)返。東方的生活觀念對羅馬形成重大的沖擊,人們開始自由戀愛結(jié)婚,離婚盛行,同居通奸屢見不鮮。在這種情況下,奧古斯都試圖通過法律來干預(yù)私人的道德領(lǐng)域,以期建立和塑造帝國初期的文化。奧古斯都道德法的主要內(nèi)容是通過獎(jiǎng)懲手段來規(guī)范婚姻,對通奸行為進(jìn)行了懲罰,對行賄以及奢侈行為進(jìn)行限制。這部法律在羅馬法律史上具有重要地位,它上承羅馬共和國,下啟羅馬帝國,是理解當(dāng)時(shí)社會(huì)狀態(tài)的重要資料�；诖�,本文從唯物史觀和全球史觀出發(fā),力圖分析奧古斯都道德法的背景、內(nèi)容、特征及其影響。本文分為緒論、正文和結(jié)語三大部分。緒論部分主要介紹了國內(nèi)外研究現(xiàn)狀和研究意義。正文部分主要分為三章,第一章內(nèi)容是分析奧古斯都道德法產(chǎn)生的背景,主要內(nèi)容有羅馬法在發(fā)展中遇到的問題、古羅馬社會(huì)在共和轉(zhuǎn)型期所遭遇的變化、共和未期內(nèi)戰(zhàn)的結(jié)束和元首制的建立;第二章重點(diǎn)分析了奧古斯都道德法設(shè)立的過程和內(nèi)容,分為三個(gè)部分,第一部分是奧古斯都道德法的內(nèi)容,主要包括了《關(guān)于各個(gè)階層結(jié)婚的尤莉亞法》(lex Iulia de maritandis ordinibus)和《關(guān)于懲治通奸的尤莉亞》(lex Iulia de adulteriis coercendis)、《帕皮烏斯·波貝烏斯法》(lex Papia Poppaea)、《關(guān)于懲治奢侈的尤莉亞》(lex Iulia de sumptuary)、《關(guān)于懲治行賄的尤莉亞法》(lex Iulia de Ambitu),第二部分從政治、人口、道德、意識(shí)形態(tài)等幾方面來分析奧古斯都道德法制定的原因,第三部分則是分析了奧古斯都道德法的特點(diǎn)；第三章分析了奧古斯都道德法的影響,包含了五個(gè)方面,第一是奧古斯都道德法的延續(xù)和結(jié)果、第二是奧古斯都道德法對法律的影響、第三是奧古斯都道德法對社會(huì)生活的影響、第四是奧古斯都道德法對政治生活的影響、第五是奧古斯都法的現(xiàn)實(shí)意義。最后還啟示我們在研究歷史問題時(shí)中要將研究對象置于歷史的長河中,從宏觀和微觀的角度全面分析問題。
[Abstract]:After defeating Anthony in 31 BC, Octavian established the Roman Empire and became the supreme ruler of the country. At the beginning of the empire Octavian embarked on a series of political economic cultural and legal reforms. Augustus moral law is an important part of these many reforms. Since the third century B.C., with constant communication with the outside world, the simple and traditional moral concepts of Rome have gone forever. The Eastern concept of life had a great impact on Rome. People began to fall in love and marry freely, divorce prevailed, and cohabitation and adultery were common. In this context, Augustus tried to intervene in the private moral realm by law in order to build and shape the culture of the early Empire. The main content of Augustus moral law is to regulate marriage by means of rewards and punishments, to punish adultery, to restrict bribery and extravagance. This law plays an important role in the history of Roman law. Based on this, this paper tries to analyze the background, content, characteristics and influence of Augustus moral law from historical materialism and global historical view. This paper is divided into three parts: introduction, text and conclusion. The introduction mainly introduces the research status and significance at home and abroad. The main body is divided into three chapters, the first chapter is to analyze the background of Augustus moral law, the main content of Roman law in the development of the problems encountered, the ancient Roman society in the Republican transformation period encountered changes. The end of the civil war and the establishment of the head of state; The second chapter focuses on the process and content of the establishment of Augustus moral Law, which is divided into three parts. The first part is the content of Augustus moral Law. Mainly included the "Ulia Act on Marriage of all classes" (lex Iulia de maritandis ordinibus) and "Juillia > (lex Iulia de adulteriis coercendis)," on the punishment of adultery < Papius Popeius Act > (lex Papia Poppaea), The second part of (lex Iulia de Ambitu), analyzes the reasons for the enactment of Augustus moral Law from the aspects of politics, population, morality, ideology, etc. The third part is the analysis of the characteristics of Augustus moral law; The third chapter analyzes the influence of Augustus' moral law, including five aspects: the first is the continuation and result of Augustus' moral law, and the second is the influence of Augustus' moral law on the law. The third is the influence of Augustus moral law on social life, the fourth is the influence of Augustus moral law on political life, and the fifth is the practical significance of Augustus law. Finally, it is revealed that we should put the object of study in the long river of history and analyze the problem comprehensively from the macro and micro angles in the study of historical problems.
