【摘要】：東京審判,即第二次世界大戰(zhàn)后各國依據(jù)《遠東國際軍事法庭憲章》審判日本戰(zhàn)爭罪犯的法庭及其審判活動。東京審判以法律手段懲治了戰(zhàn)爭罪犯,有力打擊了日本軍國主義勢力及其追隨者,但一直以來,日本右翼勢力陰魂不散,軍國主義思潮沉渣泛起,屢屢企圖為侵略歷史翻案,并試圖否定東京審判。我國民眾對“東京審判”知之甚少,對東京審判中涉及的國際刑事法律問題更是知之甚少。本文主要分為五個部分,對東京審判中的法律問題進行分析研究。第一部分概述了東京審判的過程；第二部分詳細闡述了東京審判中存在的法律問題,包括程序、實體、責任承擔及刑罰執(zhí)行等四方面；第三部分是針對第二部分提出的問題進行原因分析與法理分析,同時提出自己的思考；第四部分論述東京審判對國際刑事法律發(fā)展的啟示與影響；第五部分是對東京審判政治影響的歸納�？傊�,本文試通過深入分析東京審判中存在的法律爭議、產(chǎn)生原因以及對國際刑事法律發(fā)展的影響等問題,從法律角度對東京審判進行研究分析,在提出個人思考的同時,對企圖否定歷史,否定東京審判正當性、合法性的勢力及學說以法理的有力回應。同時借以本文紀念戰(zhàn)爭死難者,警醒人們銘記歷史,珍愛和平。
[Abstract]:Tokyo trial, that is, the trial of Japanese war criminals in accordance with the Charter of the International military Tribunal in the far East after the second World War. The Tokyo trial punished the war criminals by legal means, and has been able to crack down on the Japanese militarist forces and their followers. But all along, the right-wing forces in Japan have been hanging around, and the militarist ideological trend has been rife, repeatedly attempting to reverse the case for the history of aggression. And tried to deny the Tokyo trial. Our people know little about Tokyo trial, and even less about the international criminal law involved in Tokyo trial. This paper is divided into five parts to analyze and study the legal problems in Tokyo trial. The first part summarizes the process of Tokyo trial, the second part expounds the legal problems in Tokyo trial in detail, including four aspects: procedure, entity, responsibility and penalty execution. The third part is the reason analysis and legal theory analysis of the second part, the fourth part discusses the enlightenment and influence of Tokyo trial on the development of international criminal law. The fifth part is a summary of the influence of Tokyo trial politics. In a word, this paper tries to analyze the legal disputes existing in the Tokyo trial, the causes and the influence on the development of the international criminal law from the legal point of view. Attempts to deny history, to deny the legitimacy of the Tokyo trial, the forces and doctrines of legitimacy respond with legal power. At the same time, this article to commemorate the war victims, alert people to remember history, cherish peace.
