【摘要】： 第二次世界大戰(zhàn)后,全球經(jīng)濟(jì)開(kāi)始復(fù)蘇,國(guó)際間貿(mào)易聯(lián)系增加.海洋作為重要的交通運(yùn)輸通道,其地位呈逐漸上升之勢(shì)。但是隨著海洋運(yùn)輸業(yè)的發(fā)展,因船舶事故、傾倒、排油等行為導(dǎo)致的海洋污染問(wèn)題也日益嚴(yán)重。船舶污染不但破壞海洋的生態(tài)系統(tǒng),對(duì)人類(lèi)的生活健康也有一定的危害。周?chē)Ｑ蟓h(huán)境的日益惡化,同時(shí)喚醒了公眾對(duì)環(huán)境問(wèn)題的覺(jué)醒。 面對(duì)海洋環(huán)境的日益惡化,及國(guó)內(nèi)環(huán)保運(yùn)動(dòng)的高漲,尼克松政府上臺(tái)之后,就解決國(guó)際船舶污染問(wèn)題出臺(tái)了一系列政策。主要體現(xiàn)在三個(gè)方面:首先,加強(qiáng)地區(qū)合作,推動(dòng)北大西洋公約組織建立現(xiàn)代社會(huì)挑戰(zhàn)委員會(huì)(Committee on the Challenges of Modern Society ),該委員會(huì)在美國(guó)政府的支持下達(dá)成了在1975年內(nèi)禁止船舶在航行中向海洋排污的協(xié)議。其次,參加國(guó)際會(huì)議尋求國(guó)際合作解決船舶污染問(wèn)題。通過(guò)參加聯(lián)合國(guó)下屬的政府間海事協(xié)商組織(Inter-governmental Maritime Consultative Organization)召開(kāi)的海洋污染會(huì)議,簽訂《關(guān)于干預(yù)公海油污染事件的國(guó)際公約》(The International Convention for Prevention of Pollution of the Sea by Oil ),其賦予沿海國(guó)家在其本國(guó)領(lǐng)海即將遭遇船舶事故等威脅時(shí),有權(quán)采取措施予以防止、減輕或消除這種威脅的權(quán)利;參加1972年聯(lián)合國(guó)召開(kāi)的人類(lèi)環(huán)境會(huì)議(UN Conference on the Human Environment),會(huì)議通過(guò)了《人類(lèi)環(huán)境宣言》(Declaration on the Human Environment),會(huì)議宣告了人類(lèi)對(duì)環(huán)境的傳統(tǒng)觀(guān)念的終結(jié),達(dá)成了“只有一個(gè)地球”,人類(lèi)與環(huán)境是不可分割的“共同體”的共識(shí)。為以后國(guó)際社會(huì)解決環(huán)境問(wèn)題初步奠定了國(guó)際合作的模式;最后,美國(guó)環(huán)境根據(jù)環(huán)境質(zhì)委員會(huì)的報(bào)告提出簽訂《防止傾倒廢物及其它物質(zhì)污染海洋公約》(Convention on the Prevention of Marine Pollution by Dumping of Wastes and Other Matter),該公約對(duì)規(guī)范國(guó)際無(wú)秩序的海洋傾倒行為有重要的作用。 尼克松政府的解決國(guó)際船舶污染政策不但有效的解決了美國(guó)沿海港口的船舶污染問(wèn)題,同時(shí)也推動(dòng)了國(guó)家間的海洋環(huán)保模式的初步建立。相比較以往歷屆政府都有顯著的進(jìn)步與提高,可以說(shuō)尼克松政府環(huán)境政策對(duì)后來(lái)美國(guó)環(huán)保運(yùn)動(dòng)的發(fā)展具有重大的影響,基本上構(gòu)筑了美國(guó)環(huán)保政策的基本框架。但是作為冷戰(zhàn)背景下的超級(jí)大國(guó)美國(guó),其環(huán)境政策深受冷戰(zhàn)思維的影響,政策的制定是以不侵害美國(guó)的國(guó)家安全利益和維護(hù)海洋自由航行為前提的。
[Abstract]:After World War II, the global economy began to recover and international trade ties increased. As an important transportation channel, the status of the ocean is gradually rising. However, with the development of marine transportation, marine pollution caused by ship accidents, dumping and oil discharging is becoming more and more serious. Ship pollution not only destroys the marine ecosystem, but also endangers human life and health. The worsening of the surrounding marine environment and the awakening of the public to environmental problems. In the face of the deteriorating marine environment and the upsurge of the domestic environmental movement, after the Nixon administration came to power, A series of policies were put forward to solve the pollution problem of international ships. This is mainly reflected in three aspects: first, strengthening regional cooperation, Push for the North Atlantic Treaty Organization's the Committee on the challenges of Modern Society, which, with the support of the United States government, agreed to ban ships from discharging pollutants into the ocean during navigation in 1975. Second, to participate in international conferences and seek international cooperation to solve the problem of pollution from ships. By participating in the Conference on Marine pollution convened by Intergovernmental Maritime Consultative Organization (IMCO), a subsidiary of the United Nations, The signing of the International Convention on intervention in High Seas Oil pollution incidents / the International Convention for Prevention of pollution by Oil in the Sea, which gives coastal States the right to take measures to prevent such threats as ship accidents in their territorial waters, The right to mitigate or eliminate such threats; to participate in the 1972 United Nations Conference on the Human Environment Conference on the Human Environment, which adopted the Declaration on the Human Environment, which declared the end of traditional human perceptions of the environment, There is a consensus that there is only one Earth, and that man and the environment are inseparable communities. For the future international community to solve environmental problems initially laid a model for international cooperation; finally, The United States Environment proposes to sign the Convention on the Prevention of Marine pollution by Marine pollution by dumping of wastes and other matter, based on the report of the Commission on Environmental quality. The Convention on the Prevention of Marine pollution by dumping of wastes and other matter, which regulates the international and non-orderly dumping of the sea, is based on the report of the Committee on Environmental quality. The Nixon administration's policy to deal with international ship pollution not only effectively solved the problem of ship pollution in the coastal ports of the United States, At the same time, it also promotes the initial establishment of marine environmental protection model between countries. Compared with previous administrations, the environmental policy of Nixon administration had a great influence on the development of the environmental protection movement in the United States, and basically constructed the basic framework of the environmental protection policy of the United States. However, as a superpower under the background of the Cold War, the environment policy of the United States is deeply influenced by the thinking of the cold war. The policy formulation is based on the premise of not infringing on the national security interests of the United States and safeguarding the freedom of navigation of the sea.
