【摘要】： 中世紀(jì)的英國(guó)莊園法庭,是在11世紀(jì)莊園經(jīng)濟(jì)在歐洲占據(jù)主導(dǎo)地位之后出現(xiàn)的,在英國(guó)中世紀(jì)的鄉(xiāng)村社會(huì)中,占據(jù)著十分重要的位置。早在1066年諾曼征服之前的盎格魯撒克遜時(shí)期,英國(guó)就已經(jīng)存在著莊園法庭的雛形,領(lǐng)主通過(guò)領(lǐng)主司法權(quán)對(duì)依附農(nóng)進(jìn)行控制。隨著諾曼征服之后封建制度在英國(guó)的確立,以習(xí)慣法為訴訟的依據(jù)、參與裁判制為運(yùn)行方式的莊園法庭得到進(jìn)一步確立,進(jìn)入中世紀(jì)后期,隨著諸多因素出現(xiàn)的變化,莊園法庭逐步走向衰落。由此可見(jiàn),本文是以莊園法庭的產(chǎn)生、發(fā)展以及衰落為主線來(lái)論述中世紀(jì)的英國(guó)莊園法庭。 本文圍繞著莊園法庭的產(chǎn)生、發(fā)展、衰落展開(kāi)。領(lǐng)主對(duì)農(nóng)民進(jìn)行的控制,農(nóng)民之間的關(guān)系,在公權(quán)軟弱私權(quán)強(qiáng)大的中世紀(jì)英國(guó)鄉(xiāng)村這個(gè)小社會(huì)里,這些都需要莊園法庭進(jìn)行協(xié)調(diào)。第一章論述了盎格魯撒克遜時(shí)期的領(lǐng)主司法權(quán)、莊園制的確立與莊園法庭的產(chǎn)生,旨在論述莊園法庭的出現(xiàn)并不是一個(gè)偶然的事情,而是有著深刻的背景和現(xiàn)實(shí)中的因素,本文試著從盎格魯撒克遜時(shí)期后期英國(guó)社會(huì)的變化和領(lǐng)主司法權(quán)來(lái)論述莊園制的確立以及莊園法庭的產(chǎn)生。第二章論述了莊園法庭運(yùn)行的程序、訴訟的依據(jù)、運(yùn)行方式以及法庭所具備的職能,莊園法庭之所以能夠在中世紀(jì)的英國(guó)鄉(xiāng)村社會(huì)占據(jù)重要的地位,是與其所具備的特點(diǎn)分不開(kāi)的。第三章主要寫(xiě)了農(nóng)奴制的瓦解以及普通法產(chǎn)生之后對(duì)莊園法庭司法空間的擠壓,試著分析莊園法庭存在的基礎(chǔ)-莊園制的瓦解以及王國(guó)司法的統(tǒng)一對(duì)莊園法庭產(chǎn)生的影響,最終,莊園法庭走向衰落。
[Abstract]:The medieval British manor court, which emerged in 11th century after the manor economy occupied a dominant position in Europe, was in the rural society of the Middle Ages in England. As early as 1066, before the Norman Conquest, the Anglo-Saxon period, the Court of Manor existed in England. The lord exercised control over dependent farmers through the lord's judicial power. With the establishment of feudalism in England after the Norman Conquest, customary law was the basis for litigation. The manor court that participated in the adjudication system was further established. In the late Middle Ages, with the changes of many factors, the manor court gradually declined. This paper discusses the medieval British manor courts in the main line of the emergence, development and decline of manor courts. This paper revolves around the emergence, development and decline of the manor court. The lord's control over the peasants and the relationship between the peasants are in the small society of the medieval English countryside, where the public power is weak and the private right is strong. All of these need to be coordinated by the Court of Manor. The first chapter discusses the judicial power of the lords in the Anglo-Saxon period, the establishment of the manor system and the emergence of the manor court. The purpose is to discuss the appearance of the manor court is not a accidental thing, but has a profound background and practical factors. This paper tries to discuss the establishment of manor system and the emergence of manor court from the changes of British society and the judicial power of lords in the late Anglo-Saxon period. Chapter two discusses the procedure and the basis of litigation of the manor court. The mode of operation and the functions of the court, the manor court can play an important role in the medieval English rural society. The third chapter mainly describes the collapse of serfdom and the squeezing of the judicial space of the manor court after the common law came into being. This paper tries to analyze the foundation of the existence of the manor court-the collapse of the manor system and the influence of the unification of the kingdom's judicature on the manor court. Finally, the manor court goes into decline.
