【摘要】：人權(quán)是國際政治中的重要議題,作為國際上影響力最廣的國際組織,聯(lián)合國是行使人權(quán)保護的核心。面對21世紀國際人權(quán)環(huán)境的新形勢,為促進人權(quán)領(lǐng)域的對話交流,為取代飽受詬病的前身人權(quán)委員會,在安南秘書長《大自由》報告的改革提議下,經(jīng)歷多方博弈之后人權(quán)理事會終于2006年成立。人權(quán)理事會的主要目標是充當聯(lián)合國關(guān)于人權(quán)問題對話與合作的主要論壇,通過對話、能力建設(shè)和技術(shù)援助,幫助會員國遵循人權(quán)義務(wù)并向聯(lián)合國大會提出關(guān)于進一步發(fā)展人權(quán)領(lǐng)域國際法的建議。 人權(quán)理事會成立不過五年,且作為妥協(xié)的產(chǎn)物,必然存在觀察與改進的空間。本文試圖從人權(quán)理事會成立的背景入手,結(jié)合安南秘書長改革報告分析,研究人權(quán)理事會的成立,并以2011年人權(quán)理事會對利比亞動亂中做出的舉措為例,對其運行做出評價和期許。
[Abstract]:Human rights is an important issue in international politics. As the most influential international organization, the United Nations is the core of human rights protection. In the face of the new situation in the international human rights environment in the 21st century, in order to promote dialogue and exchange in the field of human rights and to replace the much-criticized predecessor, the Commission on Human Rights, under the reform proposals of Secretary-General Annan's report in larger Freedom, After a multi-game, the Human Rights Council was finally established in 2006. The main objective of the Human Rights Council is to serve as the main United Nations forum for dialogue and cooperation on human rights issues, through dialogue, capacity-building and technical assistance, To assist member States in complying with their human rights obligations and to make recommendations to the General Assembly on the further development of international law in the field of human rights. The Human Rights Council was established only five years ago and, as a result of compromise, there must be room for observation and improvement. Starting from the background of the establishment of the Human Rights Council, this paper attempts to study the establishment of the Human Rights Council in the light of the analysis of the report of Secretary-General Annan on the reform of the Human Rights Council. Evaluation and expectation of its operation.
